<strong>City</strong> shall provide, as may be indicated in <strong>the</strong> Contract Documents, <strong>the</strong> lands upon which<br />

<strong>the</strong> Work is to be per<strong>for</strong>med, rights-<strong>of</strong>-way and easements <strong>for</strong> access <strong>the</strong>reto and such<br />

o<strong>the</strong>r lands as are <strong>design</strong>ated by <strong>City</strong> <strong>for</strong> <strong>the</strong> use <strong>of</strong> Design-Build Firm.<br />

Design-Build Firm shall provide, at Design-Build Firm‟s own expense and without liability<br />

to <strong>City</strong>, any additional land and access <strong>the</strong>reto that may be required <strong>for</strong> temporary<br />

construction facilities, or <strong>for</strong> storage <strong>of</strong> materials. Design-Build Firm shall furnish to <strong>City</strong><br />

copies <strong>of</strong> written permission obtained by Design-Build Firm from <strong>the</strong> owners <strong>of</strong> such<br />

facilities.<br />

28. Coordination <strong>of</strong> Work<br />

The Project Site(s) may be occupied and may operate on a twenty-four hour seven day<br />

a week schedule. Design-Build Firm shall ensure that <strong>the</strong> per<strong>for</strong>mance <strong>of</strong> <strong>the</strong> Work does<br />

not impact any ongoing operations at Project(s) site(s), which also includes <strong>the</strong> delivery<br />

<strong>of</strong> any materials and equipment. Access to and egress from <strong>the</strong> Project Site(s) shall be<br />

coordinated with <strong>the</strong> Project Manager to minimize interference to regular and emergency<br />

operations <strong>of</strong> <strong>the</strong> facility.<br />

During progress <strong>of</strong> Work under this Contract, it may be necessary <strong>for</strong> o<strong>the</strong>r Design-Build<br />

Firm ‟s and persons employed by <strong>the</strong> <strong>City</strong> to Work in or about <strong>the</strong> Project. The <strong>City</strong><br />

reserves <strong>the</strong> right to put such o<strong>the</strong>r Design-Build Firm s to work and to af<strong>for</strong>d such<br />

access to <strong>the</strong> Project site <strong>of</strong> <strong>the</strong> Work to be per<strong>for</strong>med hereunder at such times as <strong>the</strong><br />

<strong>City</strong> deems proper.<br />

If this Contract requires a portion <strong>of</strong> <strong>the</strong> Work to be tied into work done under o<strong>the</strong>r<br />

Contract(s), it will be necessary <strong>for</strong> Design-<strong>build</strong> Firm to plan its Work and cooperate<br />

with o<strong>the</strong>r Design-Build Firm s ins<strong>of</strong>ar as possible to prevent any interference and delay.<br />

The Design-<strong>build</strong> Firm shall not impede or interfere with <strong>the</strong> work <strong>of</strong> o<strong>the</strong>r Design-Build<br />

Firm s engaged in or about <strong>the</strong> Work and shall so arrange and conduct its Work that<br />

such o<strong>the</strong>r Design-Build Firm s may complete <strong>the</strong>ir work at <strong>the</strong> earliest date possible.<br />

29. Differing Site Conditions<br />

No adjustments to <strong>the</strong> Contract Time or Contract Price shall be approved due to differing<br />

site conditions as <strong>the</strong> Design-Build Firm is solely responsible <strong>for</strong> all aspects <strong>of</strong> <strong>design</strong><br />

and construction <strong>of</strong> <strong>the</strong> Project.<br />

30. Existing Utilities<br />

Known utilities and structures adjacent to or encountered in <strong>the</strong> Work will be shown on<br />

<strong>the</strong> Drawings. The locations shown are taken from existing records and <strong>the</strong> best<br />

in<strong>for</strong>mation available from existing plans and utility investigations; however, it is<br />

expected that <strong>the</strong>re may be some discrepancies and omissions in <strong>the</strong> locations and<br />

quantities <strong>of</strong> utilities and structures shown. Those shown are <strong>for</strong> <strong>the</strong> convenience <strong>of</strong> <strong>the</strong><br />

Design-Build Firm only, and no responsibility is assumed by ei<strong>the</strong>r <strong>the</strong> <strong>City</strong> <strong>for</strong> <strong>the</strong>ir<br />

accuracy or completeness. No request <strong>for</strong> additional compensation or <strong>contract</strong> time<br />

resulting from encountering utilities not shown will be considered. The Design-Build Firm<br />

is responsible <strong>for</strong> locating all underground utilities. The Design-Build Firm shall explore<br />

sufficiently ahead <strong>of</strong> <strong>the</strong> Work to allow time <strong>for</strong> any necessary adjustments The Design-<br />

Build Firm must coordinate all underground utility locations through “Sunshine State One<br />

Call <strong>of</strong> Florida, Inc”, who shall be contacted a minimum <strong>of</strong> 48 hours be<strong>for</strong>e <strong>the</strong> Design-<br />

Build Firm commences any digging.<br />

31. Design-Build Firm’s Responsibility <strong>for</strong> Utility Properties and Service<br />
