� Work has been inspected by <strong>the</strong> Design-Build Firm <strong>for</strong> compliance with <strong>the</strong><br />

Design Criteria.<br />

� Work has been completed in accordance with <strong>the</strong> Design Criteria<br />

� Equipment and systems have been tested in <strong>the</strong> presence <strong>of</strong> <strong>the</strong> Project<br />

Manager and/or o<strong>the</strong>r <strong>City</strong> representatives and are operational.<br />

� Work is completed and ready <strong>for</strong> Substantial Completion inspection.<br />

The Project Manager shall schedule <strong>the</strong> date and time <strong>for</strong> any inspection and notify <strong>the</strong><br />

Design-Build Firm and any o<strong>the</strong>r parties deemed necessary. During this inspection, <strong>the</strong><br />

Project Substantial Completion Inspection Form will be completed as necessary. Any<br />

remaining Construction Work shall be identified on this <strong>for</strong>m and shall be known as<br />

Punch List Work. The inadvertent omission <strong>of</strong> any item from <strong>the</strong> Punch List shall not<br />

relieve <strong>the</strong> Design-Build Firm from its obligations as detailed in <strong>the</strong> DCP and <strong>the</strong><br />

Contract. The Punch List shall be signed by <strong>the</strong> Project Manager, and <strong>the</strong> Design-Build<br />

Firm confirming that <strong>the</strong> Punch List contains <strong>the</strong> item(s) necessary to complete <strong>the</strong><br />

Work. The failure or refusal <strong>of</strong> <strong>the</strong> Design-Build Firm to sign <strong>the</strong> Project Substantial<br />

Completion Inspection Form or Punch List shall not relieve <strong>the</strong> Design-Build Firm from<br />

complying with <strong>the</strong> findings <strong>of</strong> <strong>the</strong> Project Substantial Completion Inspection and<br />

completing <strong>the</strong> Project to <strong>the</strong> satisfaction <strong>of</strong> <strong>the</strong> <strong>City</strong><br />

Where <strong>the</strong> Punch List is limited to minor omissions and defects, <strong>the</strong> Project Manager<br />

shall indicate that <strong>the</strong> Work is substantially complete subject to completion <strong>of</strong> <strong>the</strong> Punch<br />

List. Where <strong>the</strong> Project Manager determines, on <strong>the</strong> appropriate <strong>for</strong>m that <strong>the</strong> Work is<br />

not substantially complete, <strong>the</strong> Project Manager shall provide a list <strong>of</strong> all open items<br />

necessary to achieve Substantial Completion. Upon completion <strong>of</strong> such Work, <strong>the</strong><br />

Design-Build Firm shall request ano<strong>the</strong>r Substantial Completion inspection.<br />

The Project Manager and <strong>the</strong> Design-Build Firm shall agree on <strong>the</strong> time reasonably<br />

required to complete all remaining Work included in <strong>the</strong> Punch List.<br />

The <strong>City</strong> will prepare a Certificate <strong>of</strong> Substantial Completion in <strong>the</strong> <strong>for</strong>m which shall<br />

establish <strong>the</strong> Date <strong>of</strong> Substantial Completion. Once substantial completion is achieved<br />

<strong>the</strong> <strong>City</strong> shall be responsible <strong>for</strong> security, maintenance, heat, utilities, damage to <strong>the</strong><br />

Project site, and insurance; and shall list all Work yet to be completed to satisfy <strong>the</strong><br />

requirements <strong>of</strong> <strong>the</strong> Contract Documents <strong>for</strong> Final Completion. The failure to include any<br />

items <strong>of</strong> corrective Work on such list does not alter <strong>the</strong> responsibility <strong>of</strong> Design-Build<br />

Firm to complete all <strong>of</strong> <strong>the</strong> Work in accordance with <strong>the</strong> Contract Documents. Warranties<br />

required by <strong>the</strong> Contract Documents shall commence on <strong>the</strong> date <strong>of</strong> Final Acceptance<br />

completion <strong>of</strong> <strong>the</strong> Work or <strong>design</strong>ated portion <strong>the</strong>re<strong>of</strong> unless o<strong>the</strong>rwise provided in <strong>the</strong><br />

Contract Documents.<br />

61. Acceptance and Final Payment<br />

Upon receipt <strong>of</strong> written notice from Design-Build Firm that <strong>the</strong> Work is ready <strong>for</strong> final<br />

inspection and acceptance, Project Manager and/or Consultant shall, within ten (10)<br />

calendar days, make an inspection <strong>the</strong>re<strong>of</strong>. If Project Manager and/or Consultant find<br />

<strong>the</strong> Work acceptable, <strong>the</strong> requisite documents have been submitted and <strong>the</strong><br />

requirements <strong>of</strong> <strong>the</strong> Contract Documents fully satisfied, and all conditions <strong>of</strong> <strong>the</strong> permits<br />

and regulatory agencies have been met, a Final Certificate <strong>for</strong> Payment shall be issued<br />

by Project Manager, stating that <strong>the</strong> requirements <strong>of</strong> <strong>the</strong> Contract Documents have been<br />

per<strong>for</strong>med and <strong>the</strong> Work is ready <strong>for</strong> acceptance under <strong>the</strong> terms and conditions <strong>the</strong>re<strong>of</strong>.<br />
