H. Services of City Officials<br />

The Utility, when necessary, may utilize the services of the City Engineer,<br />

City Attorney, <strong>and</strong> other officials <strong>and</strong> employees. In such case the General<br />

Fund shall be reimbursed by the Utility <strong>for</strong> the cost of such services.<br />

I. Accounts <strong>and</strong> Receipts<br />

The Utility shall keep books of account <strong>and</strong> maintain funds in the manner<br />

<strong>and</strong> <strong>for</strong>m prescribed as appropriate <strong>for</strong> its operation by the auditors <strong>for</strong> the<br />

City of Marinette <strong>and</strong> the Wisconsin Public Service Commission, which<br />

shall be audited at least annually.<br />

J. Budget<br />

The Commission shall prepare, approve, <strong>and</strong> implement an annual budget.<br />

The Common Council shall receive a copy of the budget <strong>for</strong> in<strong>for</strong>mational<br />

purposes only.<br />

K. Rates<br />

The Commission, in consultation with its auditors, shall request rate<br />

adjustments when deemed appropriate by the Commission.<br />

L. Public Construction<br />

Public construction, as defined in Wisconsin Statutes Section 62.15, shall be<br />

approved by the Commission, the Board of Public Works, <strong>and</strong> the Common<br />

Council. Public construction contracts shall be signed by the Mayor <strong>and</strong> the<br />

Commission Chairperson. The Commission shall supervise any such public<br />

construction, including change orders <strong>and</strong> changes in scope of work.<br />

M. Borrowing<br />

Any borrowing of funds shall be approved by the Commission <strong>and</strong> the<br />

Common Council. Unless otherwise required by law, all borrowing<br />

documents shall be signed by the Mayor <strong>and</strong> the Commission Chairperson.<br />

N. Contracts<br />

The Commission Chairperson shall have the authority to sign all other<br />

Utility contracts, including collective bargaining agreements, not otherwise<br />

specifically mentioned in this ordinance.<br />

O. Title to Real Estate<br />

Any real estate necessary <strong>for</strong> the future operation of the Utility shall be<br />

acquired in the name of the City of Marinette.<br />

P. Other City Ordinances<br />

Unless otherwise stated above, the Utility shall continue to be governed by<br />

all other City ordinances, including Section 2.0301(F) requiring residency as<br />

a condition of employment.<br />
