2.0404 MARINETTE WASTEWATER UTILITY AND COMMISSION<br />
A. Definition<br />
The Marinette Wastewater Utility (the "Utility") shall consist of all<br />
wastewater collection <strong>and</strong> treatment facilities <strong>and</strong> operations owned or<br />
controlled by the City of Marinette.<br />
B. Creation of Board<br />
The Marinette Wastewater Utility Commission (the "Commission") is<br />
hereby created.<br />
C. Members<br />
1. The Commission shall consist of seven (7) members who shall be<br />
appointed by the Mayor subject to approval by the Common Council.<br />
Five (5) members shall be citizen members, each of whom shall be a<br />
resident of the City of Marinette. One (1) member shall be an<br />
alderperson on the Board of Public Works. One (1) member shall be an<br />
alderperson. Each member shall serve a first term beginning on the day<br />
of confirmation by the Common Council or upon effective date of this<br />
ordinance, whichever is later, <strong>and</strong> ending as follows:<br />

2. Except <strong>for</strong> the Alderperson-Board of Public Works member <strong>and</strong> the<br />
Alderperson member, after the first term, all terms of office shall be <strong>for</strong><br />
three (3) years <strong>and</strong> shall expire on the day immediately preceding the<br />
third Tuesday in April of the third year after appointment. With regard to<br />
the Alderperson-Board of Public Works member <strong>and</strong> the Alderperson<br />
member, these shall be annual appointments which shall end each year<br />
on the day immediately preceding the third Tuesday in April.<br />
3. The Mayor, subject to the approval of the Common Council, shall<br />
<strong>for</strong>thwith appoint a qualified successor to the Board <strong>for</strong> the unexpired<br />
term of any vacancy.<br />
D. Officers <strong>and</strong> Organization<br />
The Commission shall meet <strong>and</strong> organize within thirty (30) days after the<br />
appointment of the original members <strong>and</strong> shall elect from among their<br />
members a Chairperson <strong>and</strong> Secretary <strong>and</strong> shall meet thereafter at least<br />
monthly. Thereafter annually, at its first meeting following the third<br />
