7. Appeal procedure and action. An appeal is heard and decided by one board member.<br />
The board may affirm or reverse the decision of the treatment provider or agency, require further<br />
evaluation, make a finding of completion of treatment or make an alternate recommendation.<br />
The board, after due consideration, shall make a written decision and transmit that decision to the<br />
Driver Education and Evaluation Programs and the client who appealed the case. The decision of<br />
the board is final agency action for purposes of judicial review pursuant to Title 5, chapter 375,<br />
subchapter VII.<br />
Sec. XXX-6. Transition provisions. The following provisions govern the transfer from<br />
the Department of Health and Human Services to the Secretary of State of the administration of<br />
the Driver Education and Evaluation Programs.<br />
1. The Secretary of State is the successor in every way to the powers, duties and functions of the<br />
Department of Health and Human Services under Title 5, chapter 521, subchapter 5.<br />
2. All existing rules, regulations and procedures in effect, in operation or adopted by the<br />
Department of Health and Human Services or any of its administrative units or officers regarding<br />
the Driver Education and Evaluation Programs are hereby declared in effect and will continue in<br />
effect until rescinded, revised or amended by the proper authority.<br />
3. All existing contracts, agreements and compacts currently in effect under the authority of the<br />
Department of Health and Human Services regarding the Driver Education and Evaluation<br />
Programs will continue in effect under the authority of the Secretary of State.<br />
4. All records, property and equipment belonging to or allocated for the use of the Department of<br />
Health and Human Services for the purposes of the Driver Education and Evaluation Programs<br />
will, on the effective date of this Act, become the property of or allocated for the use of the<br />
Secretary of State.<br />
5. All existing forms, licenses, letterheads and similar items bearing the name of or referring to<br />
the Department of Health and Human Services used for the purposes of the Driver Education and<br />
Evaluation Programs may be used by the Secretary of State until existing supplies of those items<br />
are exhausted.<br />
PART XXX<br />
SUMMARY<br />
This Part transfers the administration of the Driver Education and Evaluation Programs<br />
(DEEP) and available funding from the Department of Health and Human Services to the<br />
Department of the Secretary of State.<br />
PART YYY<br />
Sec. YYY-1. 22 MRSA c. 1, subchapter 1-A, as amended, is repealed.<br />
