10 CONCLUSION
10.1 The applicant is seeking consent from Council to demolish/remove an existing
building from the site which is listed as a historic building in the Operative District
Plan and as a Heritage Item in the Proposed District Plan.
10.2 To demolish a historic/heritage building is a Discretionary Activity in both the
Operative and Proposed District Plans.
10.3 After having considered the application in accordance with the matters required by
Section 104, and based on the assessment undertaken by Alexy Simmons, I conclude
that:
• An assessment of the environmental effects of the proposal including concerns
raised by the submitters have been considered in this report. The conclusion of
that assessment is that the actual and potential adverse effects of allowing the
activity can be adequately mitigated subject to appropriate conditions.
Specifically, if the Committee was of the mind to approve the consent then
conditions would need to be imposed that ensure the history of the building and
site is recorded and kept for the public access.
• The objectives and policies of both Operative and Proposed District Plan have
been considered in this assessment. That assessment has concluded that the
proposal is generally inconsistent with the objectives and policies of both plans
which relates to the protection and preservation of historic/heritage buildings.
However, based on the investigation undertaken by an expert professional (Alexy
Simmons, Simmons and Associates Ltd) special circumstances are considered to
apply to the building which supports the demolition.
10.4 On the basis of the conclusions reached within Section 8.1 of this report I consider
any potential effects associated with the proposal to be more than minor. I have
however used my judgement and discretion provided by Section 104B to recommend
that land use consent be granted subject to the recommended conditions, to avoid,
remedy and/or mitigate the identified potential adverse effects, in section 11 of this
report. The recommended conditions are based on the recommendations of the
report prepared by Alexy Simmons, Simmons and Associates Ltd.
