There is still a lack of quantitative <strong>in</strong>formation or underst<strong>and</strong><strong>in</strong>g regard<strong>in</strong>g the scope <strong>and</strong><br />

development of the crime of <strong>human</strong> traffi ck<strong>in</strong>g around the world. Even basic crim<strong>in</strong>al<br />

justice data on traffi ck<strong>in</strong>g <strong>in</strong> persons offences is not publicly available for many countries<br />

<strong>and</strong> regions of the world, mak<strong>in</strong>g the compilation of accurate statistics on <strong>human</strong><br />

traffi ck<strong>in</strong>g elusive <strong>and</strong> unreliable at any level. In the absence of systematic <strong>and</strong> reliable<br />

statistical time series, we do not even know with any degree of precision if the number of<br />

reported traffi ck<strong>in</strong>g cases is <strong>in</strong>creas<strong>in</strong>g or decreas<strong>in</strong>g <strong>and</strong> why this might be so. Compil<strong>in</strong>g<br />

reliable <strong>and</strong> comprehensive statistical time series on the crim<strong>in</strong>al justice response to <strong>human</strong><br />

traffi ck<strong>in</strong>g is thus a fi rst step towards a more global underst<strong>and</strong><strong>in</strong>g of the phenomenon. 377<br />

The major problem <strong>in</strong> study<strong>in</strong>g <strong>and</strong> combat<strong>in</strong>g traffi ck<strong>in</strong>g <strong>in</strong> persons is exactly the<br />

scarcity, unreliability, <strong>and</strong> non-comparability of exist<strong>in</strong>g <strong>in</strong>ternational <strong>and</strong> national data.<br />

The absence of comparable statistics on reported crimes, <strong>in</strong>dictments <strong>and</strong> court cases, the<br />

heterogenous crim<strong>in</strong>alisation of the crime <strong>in</strong> national legislation, the characteristics of<br />

traffi ck<strong>in</strong>g which results <strong>in</strong> a high dark number <strong>and</strong> makes traffi ck<strong>in</strong>g hard to identify, the<br />

weak legal status of victims <strong>in</strong> national legislation, which contributes to their reluctance<br />

to report the crime <strong>and</strong> the <strong>in</strong>consistent use of the concept of traffi ck<strong>in</strong>g are all factors<br />

that contribute to <strong>in</strong>accuracy of data. 378<br />

One of the major hurdles to undertak<strong>in</strong>g a comparative analysis of traffi ck<strong>in</strong>g data is the<br />

lack of specifi c legislation on the national level. This leads to absence of offi cial crim<strong>in</strong>al<br />

justice statistics on <strong>human</strong> traffi ck<strong>in</strong>g cases. The traffi ck<strong>in</strong>g Protocol has improved the<br />

situation with its agreed defi nition of the crime <strong>and</strong> when countries reform legislation <strong>in</strong><br />

order to conform with this defi nition, data collection will be easier. The confusion between<br />

smuggl<strong>in</strong>g <strong>and</strong> traffi ck<strong>in</strong>g is important when collect<strong>in</strong>g data, because the police may<br />

prefer to categorise some traffi ck<strong>in</strong>g cases as smuggl<strong>in</strong>g crimes, the collection of evidence<br />

<strong>in</strong> these last is easier than obta<strong>in</strong><strong>in</strong>g evidence on offences related to traffi ck<strong>in</strong>g. 379<br />

The trade <strong>in</strong> <strong>human</strong> be<strong>in</strong>gs is not a uniform bus<strong>in</strong>ess <strong>and</strong> operates very differently <strong>in</strong><br />

different cultural <strong>and</strong> political contexts. Human traffi ck<strong>in</strong>g shares much with the trade<br />

<strong>in</strong> legitimate commodities from the region of orig<strong>in</strong>. Traditional patterns of trade <strong>and</strong><br />

<strong>in</strong>vestment shape the trade <strong>in</strong> <strong>human</strong> be<strong>in</strong>gs as they do trade <strong>in</strong> other “commodities”. 380<br />

Enormous differences exist <strong>in</strong> the trade of <strong>human</strong> be<strong>in</strong>gs from e.g. post-socialist countries.<br />

Ch<strong>in</strong>a uses trade <strong>in</strong> people to generate revenue for <strong>in</strong>vestment whereas the traffi ckers<br />

from the former USSR sell off <strong>human</strong> be<strong>in</strong>gs as if they were a natural resource like oil<br />
