Conclusions<br />

Traffi ck<strong>in</strong>g <strong>in</strong> <strong>human</strong> be<strong>in</strong>gs as a crime has now been established <strong>in</strong> the texts of many<br />

national legislations as a consequence of <strong>in</strong>ternational agreements <strong>and</strong> conventions. The<br />

path towards harmonisation of defi nitions has started even if it is not yet completed. If<br />

traffi ck<strong>in</strong>g <strong>in</strong> <strong>human</strong> be<strong>in</strong>gs is a reward<strong>in</strong>g bus<strong>in</strong>ess for many organised crime groups it is<br />

also the vehicle for many desperate people to leave low social <strong>and</strong> economic conditions for<br />

someth<strong>in</strong>g they believe to be better. The real issue today is to underst<strong>and</strong> the phenomenon<br />

<strong>and</strong> its many angles to fi nd proper remedies. It is a typical crim<strong>in</strong>al <strong>in</strong>termediation that<br />

helps meet two illegal dem<strong>and</strong>s: the grow<strong>in</strong>g dem<strong>and</strong> for irregular migration possibilities<br />

<strong>and</strong> the grow<strong>in</strong>g dem<strong>and</strong> for prostitutes <strong>and</strong> manual work etc. Human smuggl<strong>in</strong>g <strong>and</strong> its<br />

violent appendix of traffi ck<strong>in</strong>g <strong>in</strong> <strong>human</strong> be<strong>in</strong>gs is the result of opportunities provided to<br />

crim<strong>in</strong>als by the diffi culty/<strong>in</strong>capacity to regulate migration fl ows. 442<br />

Focus<strong>in</strong>g on the dimension of <strong>human</strong> traffi ck<strong>in</strong>g is not signifi cant <strong>in</strong> itself – it is<br />

important to underst<strong>and</strong> <strong>and</strong> measure for which purpose traffi ck<strong>in</strong>g happens, i.e. <strong>in</strong><br />

which specifi c market traffi cked people are exploited. This will allow design<strong>in</strong>g more<br />

focused <strong>and</strong> effective <strong>in</strong>terventions. This means the implementation of policies oriented<br />

<strong>in</strong> detect<strong>in</strong>g <strong>and</strong> deterr<strong>in</strong>g dem<strong>and</strong>s for prostitution, drugs, work, <strong>and</strong> organs, <strong>and</strong> <strong>in</strong><br />

br<strong>in</strong>g<strong>in</strong>g these black markets to a legal dimension. It is necessary to underst<strong>and</strong> that not<br />

all forms of exploitation are the same <strong>and</strong> to assess dem<strong>and</strong>s <strong>and</strong> supply <strong>in</strong> the different<br />

markets by separat<strong>in</strong>g the legal ones from the illegal ones, to develop crim<strong>in</strong>al sanctions<br />

<strong>and</strong> regulatory dis<strong>in</strong>centives <strong>in</strong> the labour market. Many of these are already <strong>in</strong> place <strong>in</strong><br />

several legislation but they are lack<strong>in</strong>g implementation. 443<br />

The Protocol is not perfect – but the fact that traffi ck<strong>in</strong>g happens <strong>and</strong> that victims do<br />

not receive suffi cient protection is not only because of fl aws <strong>in</strong> the Protocol, but due to<br />

many <strong>and</strong> varied problems related to implementation. It may seem banal, but it may<br />

be opportune to recall that hav<strong>in</strong>g a perfect law which crim<strong>in</strong>alises murder or theft<br />

does not automatically mean that murder or theft will not occur. But the Protocol does<br />

give several possibilities to prosecute <strong>and</strong> prevent abuse <strong>and</strong> exploitation <strong>in</strong> countries of<br />

dest<strong>in</strong>ation. 444 Implementation is much more <strong>and</strong> has to be multifaceted. Tra<strong>in</strong><strong>in</strong>g <strong>and</strong><br />
