Hence, migration departments <strong>and</strong> labour market <strong>in</strong>stitutions, such as labour m<strong>in</strong>istries,<br />
labour <strong>in</strong>spectors, national employment services, <strong>and</strong> vocational tra<strong>in</strong><strong>in</strong>g schools, have<br />
a key role to play <strong>in</strong> the implementation of such preventive measures. Despite grow<strong>in</strong>g<br />
recognition that <strong>human</strong> traffi ck<strong>in</strong>g needs to be tackled through a holistic approach, antitraffi<br />
ck<strong>in</strong>g strategies still rema<strong>in</strong> isolated from other national policies, for example policies<br />
on employment <strong>and</strong> vocational tra<strong>in</strong><strong>in</strong>g, gender discrim<strong>in</strong>ation or poverty reduction <strong>and</strong><br />
migration management. 418<br />
Construct<strong>in</strong>g a national plan to combat traffi ck<strong>in</strong>g is a long <strong>and</strong> complex process, <strong>in</strong>volv<strong>in</strong>g<br />
various actors. It requires the government to facilitate participation of civil society <strong>in</strong><br />
the draft<strong>in</strong>g process so that the product merges concerns of various social movements.<br />
It requires coord<strong>in</strong>ation momentum to ensure that political commitment at the state<br />
<strong>and</strong> municipal levels can give mean<strong>in</strong>g to the plan, with <strong>in</strong>tegrated networks of various<br />
agencies (health, justice, security, women’s policies <strong>and</strong> others) work<strong>in</strong>g cooperatively<br />
with civil society groups, <strong>in</strong>ternational organizations <strong>and</strong> the private sector. One of the<br />
challenges posed by this process is the need for widespread underst<strong>and</strong><strong>in</strong>g of the defi nition<br />
of traffi ck<strong>in</strong>g <strong>and</strong> for that defi nition to be aligned with the Traffi ck<strong>in</strong>g Protocol. This must<br />
then be refl ected <strong>in</strong> national laws, which crim<strong>in</strong>alize both <strong>in</strong>ternal <strong>and</strong> trans-national<br />
traffi ck<strong>in</strong>g, address traffi ck<strong>in</strong>g <strong>in</strong> men <strong>and</strong> children, as well as women, <strong>and</strong> acknowledge<br />
the various forms of exploitation. To give mean<strong>in</strong>g to such law, law enforcement <strong>and</strong><br />
judicial authorities must adequately underst<strong>and</strong> it <strong>and</strong> be empowered to implement it<br />
while non-governmental organizations <strong>and</strong> civil society must be equipped to cooperate <strong>in</strong><br />
prevent<strong>in</strong>g traffi ck<strong>in</strong>g <strong>and</strong> assist<strong>in</strong>g victims. Throughout the entire process of design<strong>in</strong>g<br />
<strong>and</strong> implement<strong>in</strong>g a national plan of action, public awareness must be raised with strong<br />
campaigns capable of reach<strong>in</strong>g even the most vulnerable people. 419<br />
In November 2008 a work<strong>in</strong>g group was established with<strong>in</strong> the UN which was charged<br />
with improv<strong>in</strong>g implementation of the UNTOC <strong>and</strong> its two Protocols, recognis<strong>in</strong>g the<br />
problems h<strong>in</strong>der<strong>in</strong>g effective enforcement of the <strong>in</strong>struments. Aga<strong>in</strong> such a focus will<br />
not only benefi t crim<strong>in</strong>al law <strong>and</strong> law enforcement, but cannot but br<strong>in</strong>g focus to States’<br />
obligations also <strong>in</strong> relation to protection – thus br<strong>in</strong>g<strong>in</strong>g focus to broader <strong>human</strong> <strong>rights</strong><br />
issues as well.<br />
The Government of Thail<strong>and</strong> has adopted a plan of action to prevent traffi ck<strong>in</strong>g, protect <strong>and</strong><br />
re<strong>in</strong>tegrate victims <strong>and</strong> prosecute traffi ckers. The national policy calls for a total elim<strong>in</strong>ation of the<br />
<strong>in</strong>volvement of children <strong>in</strong> commercial sex activities. The use of violence, threats, <strong>in</strong>timidation <strong>and</strong><br />
exploitation <strong>in</strong> the sex <strong>in</strong>dustry is to be prohibited <strong>and</strong> all persons who take part <strong>in</strong> the prostitution<br />
of children should be punished. The policy also calls for the punishment of offi cials negligent <strong>in</strong>, or<br />
choos<strong>in</strong>g to ignore, their duty to enforce compliance with relevant policies, law, rules <strong>and</strong> regulations.<br />
The comprehensive plan <strong>in</strong>cludes prevention measures, victim protection measures, measures for the<br />
repatriation <strong>and</strong> re<strong>in</strong>tegration of victims, as well as measures for the crim<strong>in</strong>alization <strong>and</strong> prosecution<br />
of offenders <strong>in</strong>volved <strong>in</strong> <strong>human</strong> traffi ck<strong>in</strong>g for the purpose of exploitative sex.<br />
