petioner would further represent unto your Honor that the said James Collins deceased died leaving the following<br />
children viz: Joshua Collins James Dorcas Susan Ketura E Claiborne and Martha Collins. That Joshua Collins has<br />
since died leaving a widow Elizabeth Collins & the following children to wit Sarah See ( or Lee?) wife and relict<br />
of Samual See deceased over the age of 21, James Collins Jr Jack Collins Daniel Collins Lewis and Williamson<br />
Collins all of who in are over the age of twenty-one and reside in the county and state aforesaid and also Susan<br />
wife of Thomas Patterson who died leaving a son named Lewis now about six years old living with his father in<br />
the State of <strong>Mississippi</strong>- That James Collins is also dead, and left the following children, who are now living-<br />
Mary Ann Davis wife of George W. Davis over the age of twenty one and resides in the county of Greene and<br />
State of Alabama Martha Collins over twenty one who resides in Sumter Co. Alabama John H Collins over twenty<br />
one and resides in Anderson Co Texas Jefferson Collins and resides in Octibeha Co. <strong>Mississippi</strong> and Nancy B<br />
Collins about sixteen years old and resides in<br />
the County of Greene and State of Alabama. with George W. Davis- That Dorcas Collins married William<br />
Nimmons and is now his wife- is over twenty one and resides in South Carolina That Susan married John E<br />
Steinwinder is over the age of twenty one and now resides in LaFayette Co <strong>Mississippi</strong>- That Ketura E is now thewife<br />
of James Porter to whom she was married is over the age of twenty one and resides in the &County & State<br />
aforementioned That Claiborne is over the age of twenty one and resides in the county of Choctaw and State of<br />
Alabama That Martha married A. M. Dowling whom she survived and afterwards died leaving three children<br />
whose names are as follows- Ann who is now the wife of Duncan Briggs is over the age of twenty one and resides<br />
in Sumter Co Alabama and Ellen wife of _____ is over the age of twenty one and resides in <strong>Mississippi</strong> and<br />
James all of whom. are the said children of the said Martha by the said A. M. Dowling- Your Petioner would<br />
represent unto your Honor that the said land cannot be equitably divided amongst the aforementioned heirs of the<br />
said James Collins Sr. deceased without a sale thereof Now therefore your Petitioner prays your Honor to order a<br />
sale of said tract or parcel of land for the aforementioned. And to grant and make all other and further such orders<br />
as may be necessary and proper in the premises. And as in duty bound will ever pray Subscribed & sworn to as<br />
being correct to the best of his knowledge & belief before me this 19th May 1853<br />

Joshua Collins one of the defendants in this case make oath that Daniel Collins is an important witness for him in<br />
the trial of this case by whom he expects to prove that the dec Ja Collins was totally incompetent to make a will at<br />
the time the paper offered to the Court bears date and that the said James Collins dec never expressed to him in<br />
his last sickness a wish. to dispose of his property other than as the law. directs and he was frequently with him,<br />
that the witness is an own brother of the decd with whom there was friendly understanding and a great intimacy<br />
that John Collins is also an important witness by whom he expects to prove the same facts. That both. of the said<br />
witnesses were directed to (be) summoned & they either have been summoned or the Sheriff has been prevented<br />
from executing the process by an understanding between the parties that the case was to be no further prosecuted<br />
He cannot go to trial without them & pray a continuance.<br />

Clairborn Collins saith that Lazarus Whitehead by reason of bodily infirmity is not able to attend as a witness to<br />
prove the contested will of James Collins deceased. 19 Oct. 1836 (All the forgoing documents were from the<br />
original file of papers concerning estate of James Collins Sr. deceased in File # 318. Some other Collins estates<br />
were Files viz: Richard Collins # 18; N. H. Collins # 4; Daniel Collins # 659; Collins minors # 660 and Stephen<br />
Collins # 1363.<br />

Mary's Mother was Thamer (Powell) Odom and this is her Mother's will, written 21 May 1808 and Probated 15<br />

I Thamer Odom of the State and District aforesaid A widow bed sick and weak in body but of sound mind and<br />
memory praised be to God for the same. I do make and declare this my last will and Testament in the manner and<br />
form following. First I give and bequeath unto James Collins my Son In Law one mare and colt known by the<br />
name of Pockett, also one negro man Named Taph, also all my stock of horses, except one yearling mare colt, and<br />
all my stock of Hogs marked with a crop and under the heel in each ear, also all my plantation tools, Secondly I<br />
