Un tratadode límites había sido concluido entre Siam y Francia como potencia colonial sobrela Indochina. El tratado en sí no era materia de objeción, pero uno de los mapassituaba al Templo en territorio indochino. Tailandia, sucesor de Siam, objetabala validez del trazo contenido en ese mapa. El tema se había complicado porqueen el curso de las negociaciones se habían sucedido al menos dos comisionesmixtas encargadas de demarcar el límite, dejando inconclusos algunos de lostrabajos. En particular, el mapa en cuestión había sido trabajado por una de lascomisiones que cesó en sus funciones y no estaba claro si este mapa había sidofinalmente aprobado por esa comisión, alguna otra o ninguna. En consecuencia,era la suerte corrida por ese mapa dentro de la relación bilateral, y no el tratadoen sí cuya validez no era contestada, la que determinaría la posición de las partes.La Corte señala:The real question, therefore, which is the essential one in this case, iswhether the Parties did adopt the Annex 1 map, and the line indicated onit, as representing the outcome of the work of delimitation of the frontier inthe region of PreahVihear, thereby conferring on it a binding character 43 .La falta de objeción al mapa en cuestión marcaría el inicio del periodo atener en cuenta.It is clear from the record that the publication and communication of theeleven maps referred to earlier, including the Annex 1 map, was something ofan occasion.
