Saksi atau pelapor atas suatu pelanggaran<br />

yang dilakukan karyawan atau manajemen<br />

perusahaan perlu dilindungi agar memotivasi<br />

pemangku kepentingan tersebut untuk<br />

melaporkan pelanggaran yang terjadi. Hal tersebut<br />

dapat dilaksanakan melalui penerapan sistem<br />

whistleblowing yang dirancang dengan baik, yang<br />

pada akhirnya akan bermuara pada pembentukan<br />

budaya tata kelola perusahaan yang baik.<br />

WHISTLEBLOWING SYSTEM<br />

Any witness or complainant to an offense<br />

committed by an employee or the management<br />

of a company needs to be protected in order to<br />

motivate stakeholders to report the occurrence<br />

of violations. This can be done through the<br />

implementation of a well-designed whistleblowing<br />

system, which will eventually lead to the<br />

establishment of a good corporate governance<br />

culture.<br />

capital allocation and investment horizon. As a general rule, vesting of long-term incentives<br />

Undang-Undang Nomor 13/2006 tentang<br />

Perlindungan Saksi dan Korban telah mengatur<br />

perlindungan bagi saksi dan korban pelapor<br />

suatu perkara pidana. Undang-undang ini dapat<br />

digunakan sebagai acuan oleh perusahaan untuk<br />

menyusun mekanisme whistleblowing. Pada tahun<br />

2008, KNKG telah mengeluarkan pedoman khusus<br />

tentang sistem dan prosedur whistleblowing.<br />

Pelanggaran yang dapat dilaporkan melalui sistem<br />

Law No. 13 year 2006 regarding Protection of<br />

Witnesses and Victims sets up protection for<br />

witnesses and victims in reporting a criminal<br />

case. This law can be used as a reference by the<br />

company to prepare a whistleblowing mechanism.<br />

In 2008 KNKG issued a specific guideline on<br />

whistleblowing systems and procedures. Violations<br />

that can be reported through the whistleblowing<br />

system include: violations of laws and regulations,
