ABSTRACT
The theme has as objective to disclose the possibility of imputation of civil
liability for the financial institutions that leave to take precautions, pointing
improperly to protest the banking billet.
Even before its wide use, banking billet can not be characterized as a
secutities, or even as any other instrument to be taken to notary protest,
mainly because it is a unilateral document that does not fit into any one
characteristics imposed by the Law.
Regardless of non characterization of banking billet as a security, this type of
document has constantly been the object of the protest in front of the notary
offices.
In most of the cases, the pointing to protest of the banking billet have been
made not only by those who emit, but also by banks, albeit in the form of
endorsement.
Thus, once involved in this illegal practice notably, the banks become liable
to indemnify the victims of the protest of the bank before the rules of civil
liability in the country.
