Workers cite <strong>ASU</strong> build<strong>in</strong>g safety hazards<br />

Asbes<strong>to</strong>s peril lack<br />

of fall protection<br />

among claims<br />

<strong>ASU</strong> workers last year ac<br />

cused <strong>the</strong> university of more<br />

than 20 workplace hazards that<br />

violated safety regulations<br />

But <strong>the</strong> state agency re<br />

sponsible for <strong>in</strong>vestigat<strong>in</strong>g<br />

such allegations usually direct<br />

ed <strong>Arizona</strong> <strong>State</strong> <strong>University</strong> <strong>to</strong><br />

<strong>in</strong>spect itself<br />

And <strong>ASU</strong> officials rarely<br />

found problems on <strong>the</strong>ir cam<br />

pus a Tribune review of com<br />

pla<strong>in</strong>ts shows<br />

The one time that <strong>the</strong> Arizo<br />

na Department of Occupation<br />

al Safety and Health conducted<br />

an unannounced <strong>in</strong>spection it<br />

found a university build<strong>in</strong>g su<br />

pervisor had sent his employ<br />

ees <strong>to</strong> tear down a roof loaded<br />

with asbes<strong>to</strong>s<br />

The agency <strong>in</strong>itially cited<br />

<strong>ASU</strong> for a serious violation<br />

But college officials negotiated<br />

that down <strong>to</strong> non serious as<br />

part of a settlement deal last<br />

month<br />

Before <strong>the</strong> asbes<strong>to</strong>s case<br />

<strong>the</strong> agency had decl<strong>in</strong>ed <strong>to</strong> <strong>in</strong><br />

vestigate allegations that <strong>ASU</strong><br />

put employees at risk of ex<br />

posure <strong>to</strong> mold and electrical<br />

currents and that it had leveled<br />

scaffold<strong>in</strong>g us<strong>in</strong>g phone books<br />

and didn t provide equipment<br />

<strong>to</strong> protect aga<strong>in</strong>st falls<br />

The university s health and<br />

safety office denied most of <strong>the</strong><br />

22 <strong>in</strong>dividual allegations made<br />

throughout 2007 compla<strong>in</strong>t<br />

records and <strong>in</strong>ternal e mail re<br />

cords show However <strong>ASU</strong> offi<br />

cials <strong>to</strong>ld <strong>the</strong> state agency <strong>the</strong>y<br />

couldnt confirm or deny some<br />

of<strong>the</strong> most serious alleged haz<br />

ards<br />

In Oc<strong>to</strong>ber state <strong>in</strong>spec<strong>to</strong>rs<br />

found Backus had <strong>to</strong>ld his em<br />

ployees <strong>the</strong> Lyceum Theater s<br />

porch roof he d assigned <strong>the</strong>m<br />

<strong>to</strong> remove had tested negative<br />

for asbes<strong>to</strong>s In fact he never<br />

had it tested<br />

In <strong>the</strong> process oftear<strong>in</strong>g off<br />

<strong>the</strong> roof a big cloud of dust was<br />

created that caused cough<strong>in</strong>g<br />

and water<strong>in</strong>g of <strong>the</strong> eyes <strong>the</strong><br />

employee compla<strong>in</strong>t said<br />

The employees s<strong>to</strong>pped<br />

work after just three hours<br />

worried that <strong>the</strong> 69 year old<br />

<strong>the</strong>ater did conta<strong>in</strong> <strong>the</strong> car<br />

c<strong>in</strong>ogen Asbes<strong>to</strong>s only pdses<br />

a serious risk if it becomes air<br />

borne<br />

The roof had seven layers<br />

of felt paper that tested positive for<br />

asbes<strong>to</strong>s <strong>the</strong> compla<strong>in</strong>t said<br />

After <strong>the</strong> state agency cited it for<br />

a serious violation <strong>the</strong> university es<br />

tablished a more rigorous build<strong>in</strong>g<br />

permit system and added tra<strong>in</strong><strong>in</strong>g<br />

for construction supervisors <strong>to</strong> pre<br />

an <strong>ASU</strong> spokeswoman wrote <strong>in</strong> re<br />

sponse <strong>to</strong> <strong>the</strong> Tribune s questions<br />

When compla<strong>in</strong>ts are serious <strong>in</strong><br />

nature or could possibly result <strong>in</strong> se<br />

rious harm or even someone s death<br />

<strong>the</strong>n we re go<strong>in</strong>g <strong>to</strong> put a lot more<br />

If state regula<strong>to</strong>rs didn t <strong>in</strong>spect<br />

certa<strong>in</strong> alleged hazards at <strong>the</strong> univer<br />

sity Perk<strong>in</strong>s said it is likely because<br />

<strong>the</strong> compla<strong>in</strong>t didn t meet all <strong>the</strong> state<br />

agency s criteria Those criteria are<br />

that <strong>the</strong> compla<strong>in</strong>t detail a situation<br />

that could cause serious <strong>in</strong>jury that<br />

In March a compla<strong>in</strong>t said work<br />

ers repair<strong>in</strong>g <strong>the</strong> Tempe campus<br />

Mat<strong>the</strong>ws Center a two s<strong>to</strong>ry build<br />

<strong>in</strong>g kept scaffold<strong>in</strong>g level by plac<strong>in</strong>g<br />

phone books and bricks underneath<br />

<strong>the</strong> structure s legs That could de<br />

stabilize <strong>the</strong> scaffold<strong>in</strong>g and violates<br />

state and federal regulations<br />

An AsU safety official checked <strong>the</strong><br />

construction site <strong>the</strong> day after receiv<br />

<strong>in</strong>g <strong>the</strong> compla<strong>in</strong>t but <strong>the</strong> scaffold<strong>in</strong>g<br />

had already been disassembled<br />

Perk<strong>in</strong>s said construction work<br />

ers often level scaffolds with pieces<br />

of wood considered a nonserious<br />

violation<br />

However he added you re not<br />

normally go<strong>in</strong>g <strong>to</strong> f<strong>in</strong>d a phone book<br />

Less than a month later <strong>the</strong> state<br />

agency asked <strong>the</strong> university <strong>to</strong> <strong>in</strong>ves<br />

tigate ano<strong>the</strong>r potential fall risk That<br />

compla<strong>in</strong>t accused <strong>ASU</strong> construction<br />

supervisors of direct<strong>in</strong>g employees <strong>to</strong><br />

work at elevated heights without fall<br />
