started gett<strong>in</strong>g out <strong>of</strong> <strong>the</strong> "silence z<strong>on</strong>e" 35 , as <strong>on</strong>e <strong>of</strong> <strong>the</strong> journalists said, this change<br />

still has its limits. Journalists are still enjoy<strong>in</strong>g an effective freedom <strong>of</strong> speech without<br />

<strong>the</strong> fear <strong>of</strong> any oppressi<strong>on</strong>, <strong>and</strong> are still enjoy<strong>in</strong>g sufficient legal protecti<strong>on</strong> to per<strong>for</strong>m<br />

<strong>the</strong>ir duties, as c<strong>on</strong>firmed by 71% <strong>of</strong> those who participated <strong>in</strong> <strong>the</strong> experts’ op<strong>in</strong>i<strong>on</strong><br />

poll, <strong>and</strong> 50.4% <strong>of</strong> whose who took part <strong>in</strong> <strong>the</strong> public op<strong>in</strong>i<strong>on</strong> poll (32bis). This can be<br />

noticed at both <strong>the</strong> legal <strong>and</strong> practical levels.<br />

On <strong>the</strong> legal level, we note that although legal restricti<strong>on</strong>s <strong>of</strong> <strong>the</strong> media <strong>in</strong> <strong>Morocco</strong><br />

have been eased, whe<strong>the</strong>r through <strong>the</strong> amendment <strong>of</strong> <strong>the</strong> <strong>Law</strong> <strong>on</strong> Press which<br />

reaffirmed <strong>the</strong> freedom <strong>of</strong> publish<strong>in</strong>g newspapers, pr<strong>in</strong>t<strong>in</strong>g <strong>and</strong> publicati<strong>on</strong>, <strong>and</strong> <strong>the</strong><br />

elim<strong>in</strong>ati<strong>on</strong> <strong>of</strong> some c<strong>on</strong>diti<strong>on</strong>s that restricted freedom <strong>in</strong> <strong>the</strong> previous law, or through<br />

<strong>the</strong> <strong>for</strong>mati<strong>on</strong> <strong>of</strong> <strong>the</strong> Supreme Commissi<strong>on</strong> <strong>for</strong> Audio-Visual Communicati<strong>on</strong>, <strong>the</strong><br />

promulgati<strong>on</strong> <strong>of</strong> <strong>the</strong> Audio-Visual Communicati<strong>on</strong> <strong>Law</strong> that rendered this type <strong>of</strong><br />

media free (Article 3), <strong>and</strong> <strong>the</strong> cessati<strong>on</strong> <strong>of</strong> <strong>the</strong> State's m<strong>on</strong>opoly <strong>of</strong> <strong>the</strong> audio-visual<br />

communicati<strong>on</strong>, some c<strong>on</strong>stra<strong>in</strong>ts rema<strong>in</strong>ed imposed <strong>on</strong> <strong>the</strong> freedom <strong>of</strong> <strong>the</strong> media.<br />

If <strong>the</strong> C<strong>on</strong>stituti<strong>on</strong> itself still <strong>in</strong>cludes some restricti<strong>on</strong>s <strong>in</strong> this field, particularly when<br />

it stipulates <strong>for</strong> <strong>the</strong> prohibiti<strong>on</strong> <strong>of</strong> discuss<strong>in</strong>g royal speeches (Article 28), most <strong>of</strong> <strong>the</strong>se<br />

restricti<strong>on</strong>s are <strong>in</strong>cluded <strong>in</strong> <strong>the</strong> laws that regulate <strong>the</strong> media.<br />

In <strong>the</strong> written press, <strong>the</strong>se restricti<strong>on</strong>s are revealed by <strong>the</strong> follow<strong>in</strong>g elements:<br />

- Oblig<strong>in</strong>g <strong>the</strong> manager <strong>of</strong> <strong>the</strong> newspaper to disclose <strong>the</strong> pr<strong>of</strong>essi<strong>on</strong>al secret <strong>and</strong><br />

reveal to <strong>the</strong> K<strong>in</strong>g's undersecretary <strong>the</strong> real identity <strong>of</strong> <strong>the</strong> article's writer <strong>in</strong> case a<br />

compla<strong>in</strong>t is filed aga<strong>in</strong>st <strong>the</strong> author <strong>of</strong> an unsigned article or an article that bears a<br />

pseud<strong>on</strong>ym. (Article 17).<br />

- Giv<strong>in</strong>g <strong>the</strong> M<strong>in</strong>ister <strong>of</strong> Communicati<strong>on</strong>s <strong>the</strong> right to prohibit all newspapers, as<br />

well as periodical or n<strong>on</strong>-periodical pr<strong>in</strong>ts published abroad from enter<strong>in</strong>g<br />

<strong>Morocco</strong> when he believes that <strong>the</strong>y <strong>of</strong>fend Islam, <strong>the</strong> m<strong>on</strong>archy or <strong>the</strong> territorial<br />

<strong>in</strong>tegrity, or <strong>in</strong>clude material that lacks <strong>the</strong> respect due to <strong>the</strong> K<strong>in</strong>g or <strong>the</strong> public<br />

order, <strong>in</strong> additi<strong>on</strong> to giv<strong>in</strong>g him <strong>the</strong> right to ban any <strong>for</strong>eign newspaper pr<strong>in</strong>ted<br />

<strong>in</strong>side <strong>Morocco</strong> <strong>for</strong> <strong>the</strong> same reas<strong>on</strong>s (Article 29).<br />

- Impos<strong>in</strong>g a sentence <strong>of</strong> impris<strong>on</strong>ment that ranges between 3 to 5 years <strong>and</strong> a f<strong>in</strong>e<br />

assessed between 10,000 <strong>and</strong> 1,000,000 Dirhams <strong>for</strong> lack<strong>in</strong>g <strong>the</strong> respect due to <strong>the</strong><br />

K<strong>in</strong>g, pr<strong>in</strong>ces or pr<strong>in</strong>cesses, or <strong>for</strong> <strong>of</strong>fend<strong>in</strong>g Islam or threaten<strong>in</strong>g <strong>the</strong> m<strong>on</strong>archy or<br />

<strong>the</strong> territorial <strong>in</strong>tegrity, with <strong>the</strong> possibility <strong>of</strong> suspend<strong>in</strong>g <strong>the</strong> newspaper or <strong>the</strong><br />

publicati<strong>on</strong> by virtue <strong>of</strong> <strong>the</strong> same judgment <strong>for</strong> a period not exceed<strong>in</strong>g three<br />

m<strong>on</strong>ths (Article 41).<br />

- Impos<strong>in</strong>g a pris<strong>on</strong> sentence <strong>and</strong> a f<strong>in</strong>e <strong>for</strong> public defamati<strong>on</strong> aga<strong>in</strong>st heads <strong>of</strong><br />

states, prime m<strong>in</strong>isters <strong>and</strong> <strong>for</strong>eign m<strong>in</strong>isters <strong>of</strong> <strong>for</strong>eign countries <strong>and</strong> <strong>the</strong>ir dignity<br />

(Article 52), or aga<strong>in</strong>st <strong>for</strong>eign diplomatic representatives or c<strong>on</strong>suls accredited or<br />

<strong>of</strong>ficially delegated be<strong>for</strong>e <strong>the</strong> K<strong>in</strong>g (Article 53).<br />

- Giv<strong>in</strong>g <strong>the</strong> M<strong>in</strong>ister <strong>of</strong> Interior <strong>the</strong> right to issue a justified decisi<strong>on</strong> <strong>of</strong><br />

adm<strong>in</strong>istrative seizure <strong>of</strong> every issue <strong>of</strong> a newspaper or periodical that breaches<br />

<strong>the</strong> public order or <strong>the</strong> respect due to <strong>the</strong> K<strong>in</strong>g, pr<strong>in</strong>ces or pr<strong>in</strong>cesses, or <strong>of</strong>fends<br />

Islam, or threatens <strong>the</strong> m<strong>on</strong>archy or <strong>the</strong> territorial <strong>in</strong>tegrity.<br />

What is more <strong>in</strong>terest<strong>in</strong>g <strong>in</strong> <strong>the</strong>se restricti<strong>on</strong>s <strong>in</strong>cluded <strong>in</strong> <strong>the</strong> Press <strong>Law</strong> is that <strong>the</strong>y are<br />

based <strong>on</strong> general <strong>and</strong> ambiguous reas<strong>on</strong>s, s<strong>in</strong>ce it is not really clear what is meant by<br />

<strong>of</strong>fend<strong>in</strong>g Islam or threaten<strong>in</strong>g <strong>the</strong> m<strong>on</strong>archy, <strong>and</strong> when <strong>the</strong>re is <strong>of</strong>fense <strong>and</strong> threat <strong>and</strong><br />
