- Moreover, judgments pr<strong>on</strong>ounced aga<strong>in</strong>st newspapers <strong>and</strong> journalists were<br />

ano<strong>the</strong>r weap<strong>on</strong>, <strong>and</strong> it was clear that it was target<strong>in</strong>g <strong>the</strong> freedom <strong>of</strong> <strong>the</strong> press:<br />

In 2000, <strong>the</strong> judgment aga<strong>in</strong>st <strong>the</strong> weekly "Le Journal" <strong>in</strong> <strong>the</strong> Moroccan<br />

Foreign M<strong>in</strong>ister's case 41 caused great turmoil <strong>in</strong> <strong>the</strong> Moroccan media,<br />

especially <strong>in</strong> terms <strong>of</strong> <strong>the</strong> large sum that <strong>the</strong> menti<strong>on</strong>ed newspaper had to<br />

pay 42 .<br />

In 2003, a few journalists were c<strong>on</strong>victed <strong>in</strong> different cases. After be<strong>in</strong>g<br />

accused <strong>of</strong> "defamati<strong>on</strong> <strong>of</strong> <strong>the</strong> sacred issues", journalist Ali al-Murabit, <strong>the</strong><br />

manager <strong>of</strong> "Dema<strong>in</strong>" magaz<strong>in</strong>e was sentenced to four years <strong>of</strong> effective<br />

impris<strong>on</strong>ment. He served seven m<strong>on</strong>ths after go<strong>in</strong>g <strong>on</strong> a hunger strike <strong>of</strong> more<br />

than 40 days. His magaz<strong>in</strong>e was also banned.<br />

Fur<strong>the</strong>rmore, after publish<strong>in</strong>g an article <strong>of</strong> <strong>on</strong>e <strong>of</strong> <strong>the</strong> "Afghan Moroccans", <strong>the</strong><br />

director <strong>of</strong> "Moroccan Life (al-Hayat al-Maghribiyyah)" newspaper, Mustafa<br />

Qishni, <strong>and</strong> director <strong>of</strong> <strong>the</strong> "Orient (al-Sharq)" newspaper, Mohammed al-<br />

Hard, both published <strong>in</strong> <strong>the</strong> city <strong>of</strong> Wajda, found <strong>the</strong>mselves be<strong>for</strong>e harsh<br />

rul<strong>in</strong>gs 43 . This was parallel to <strong>the</strong> c<strong>on</strong>stra<strong>in</strong>ts <strong>on</strong> <strong>the</strong> freedoms after <strong>the</strong> events<br />

<strong>of</strong> May 16, 2003 <strong>in</strong> Casablanca.<br />

In an event l<strong>in</strong>ked to <strong>the</strong>se events, <strong>the</strong> publish<strong>in</strong>g <strong>of</strong> a letter attributed to a<br />

movement known as <strong>the</strong> "al-Saiqa" (Thunderbolt) which claimed<br />

resp<strong>on</strong>sibility <strong>of</strong> <strong>the</strong>se events, cost <strong>the</strong> veteran Moroccan journalist, Mustafa<br />

al-Alawi, director <strong>of</strong> "al-Osboo'" (The Week), <strong>on</strong>e m<strong>on</strong>th <strong>of</strong> detenti<strong>on</strong> be<strong>for</strong>e<br />

he was sentenced <strong>for</strong> 2 m<strong>on</strong>ths <strong>of</strong> impris<strong>on</strong>ment with stay <strong>of</strong> executi<strong>on</strong> <strong>of</strong> <strong>the</strong><br />

sentence.<br />

If <strong>the</strong> issuance <strong>the</strong>reafter <strong>of</strong> a royal pard<strong>on</strong> with respect to <strong>the</strong> deta<strong>in</strong>ed journalists<br />

seemed to be <strong>the</strong> beg<strong>in</strong>n<strong>in</strong>g <strong>of</strong> a period <strong>of</strong> eas<strong>in</strong>g tensi<strong>on</strong>s between <strong>the</strong> State <strong>and</strong> <strong>the</strong><br />

press, <strong>the</strong> said period did not last l<strong>on</strong>g, as collective restricti<strong>on</strong>s were imposed aga<strong>in</strong><br />

<strong>on</strong> <strong>the</strong> press. The said new restricti<strong>on</strong>s developed <strong>the</strong> way <strong>the</strong> State dealt with <strong>the</strong><br />

press. Bann<strong>in</strong>g newspapers or deta<strong>in</strong><strong>in</strong>g journalists was no l<strong>on</strong>ger <strong>the</strong> State's weap<strong>on</strong><br />

<strong>in</strong> this regard, but o<strong>the</strong>r methods were created. Except <strong>for</strong> <strong>the</strong> case <strong>of</strong> <strong>the</strong> director <strong>of</strong><br />

<strong>the</strong> "Akhbar al-Osboo'" (Week's News), who was sentenced to six m<strong>on</strong>ths <strong>of</strong><br />

impris<strong>on</strong>ment, as he was accused <strong>of</strong> publish<strong>in</strong>g news that accused a m<strong>in</strong>ister <strong>of</strong> sexual<br />

perversi<strong>on</strong> 44 , <strong>the</strong> rul<strong>in</strong>gs <strong>in</strong> <strong>the</strong> follow<strong>in</strong>g cases had o<strong>the</strong>r <strong>for</strong>ms.<br />

In a Moroccan precedent, <strong>in</strong> 2005, journalist Ali al-Murabit (corresp<strong>on</strong>dent <strong>of</strong> Spanish<br />

daily "Il M<strong>on</strong>do") was banned from writ<strong>in</strong>g <strong>for</strong> 10 years. At <strong>the</strong> end <strong>of</strong> <strong>the</strong> same year,<br />

a series <strong>of</strong> cases were filed aga<strong>in</strong>st a number <strong>of</strong> <strong>in</strong>dependent newspapers. Two<br />

judgments were pr<strong>on</strong>ounced aga<strong>in</strong>st "Tel Qu'il" magaz<strong>in</strong>e dur<strong>in</strong>g <strong>the</strong> same period. The<br />

first <strong>on</strong>e stipulated that it pay 800,000.000 Dirhams, <strong>and</strong> <strong>the</strong> sec<strong>on</strong>d imposed a f<strong>in</strong>e <strong>of</strong><br />

be<strong>for</strong>e reduc<strong>in</strong>g this sum dur<strong>in</strong>g <strong>the</strong> appeal stage to 700,000 Dirhams ($70,000).<br />

m<strong>on</strong>ths. As <strong>for</strong> <strong>the</strong> sec<strong>on</strong>d, he was sentenced to three years <strong>of</strong> impris<strong>on</strong>ment, <strong>and</strong> his weekly was<br />

suspended <strong>for</strong> 3 m<strong>on</strong>ths.<br />

44 This case caused wide dispute, not because Anas al-Tadli, director <strong>of</strong> this newspaper, was accused <strong>of</strong><br />

publish<strong>in</strong>g news that accused F<strong>in</strong>ance M<strong>in</strong>ister Fathallah Walalo <strong>of</strong> sexual perversi<strong>on</strong>, but to activate<br />

ano<strong>the</strong>r old case aga<strong>in</strong>st him; a file that is so old <strong>and</strong> related to his customs duty evasi<strong>on</strong>.
