previous law which stated that <strong>the</strong>y could be deposited with State groups or<br />

warehouses.<br />

1-2-6-5 Prohibiti<strong>on</strong> <strong>of</strong> broadcast<strong>in</strong>g bullet<strong>in</strong>s <strong>and</strong> shows:<br />

These prohibiti<strong>on</strong>s c<strong>on</strong>cerns <strong>the</strong> bullet<strong>in</strong>s <strong>and</strong> shows, violat<strong>in</strong>g morals or caus<strong>in</strong>g harm<br />

to <strong>the</strong> youth <strong>and</strong> are broadcasted <strong>and</strong> open be<strong>for</strong>e <strong>the</strong> public. The prime m<strong>in</strong>ister or <strong>the</strong><br />

authorities, as well as <strong>the</strong> local authorities, with<strong>in</strong> <strong>the</strong>ir jurisdicti<strong>on</strong>, are authorized to<br />

impose such prohibiti<strong>on</strong>. In accordance with Article 66 <strong>of</strong> <strong>the</strong> Press <strong>Law</strong>, <strong>the</strong><br />

prohibiti<strong>on</strong> decisi<strong>on</strong> should be justified.<br />

1-3 <strong>Media</strong> Censorship<br />

Censorship, <strong>of</strong> <strong>the</strong> two types <strong>the</strong>re<strong>of</strong>, pre <strong>and</strong> post, rema<strong>in</strong>ed a sword po<strong>in</strong>ted at<br />

journalism <strong>in</strong> <strong>Morocco</strong> <strong>for</strong> a l<strong>on</strong>g time, particularly <strong>the</strong> oppositi<strong>on</strong> press. The pr<strong>in</strong>t<strong>in</strong>g<br />

<strong>of</strong>fices <strong>of</strong> many newspapers <strong>and</strong> media <strong>in</strong>stituti<strong>on</strong>s were broken <strong>in</strong>to by security<br />

<strong>for</strong>ces while <strong>the</strong>y were under pr<strong>in</strong>t.<br />

The Press <strong>and</strong> Publish<strong>in</strong>g <strong>Law</strong> does not <strong>in</strong>clude any <strong>in</strong>dicati<strong>on</strong> <strong>of</strong> such censorship.<br />

Yet, this did not prevent censorship from be<strong>in</strong>g imposed to date. The data revealed by<br />

<strong>the</strong> experts op<strong>in</strong>i<strong>on</strong> poll led to <strong>the</strong> same results. 65% <strong>of</strong> those polled c<strong>on</strong>firmed that<br />

both self <strong>and</strong> government censorship markedly obstruct <strong>the</strong> <strong>in</strong>dependence <strong>of</strong> <strong>the</strong><br />

media. The daily "An-Nahar al-Maghribiyya" had compla<strong>in</strong>ed about be<strong>in</strong>g subject to<br />

this practice <strong>on</strong> two occasi<strong>on</strong>s. On <strong>the</strong> first, it said that at <strong>the</strong> end <strong>of</strong> 2005, security<br />

<strong>for</strong>ces broke <strong>in</strong>to its pr<strong>in</strong>t<strong>in</strong>g <strong>of</strong>fice <strong>in</strong> order to exert pressure <strong>on</strong> <strong>the</strong> <strong>of</strong>ficers <strong>in</strong> charge<br />

<strong>of</strong> pr<strong>in</strong>t<strong>in</strong>g to obta<strong>in</strong> a copy <strong>of</strong> <strong>the</strong> newspaper be<strong>for</strong>e pr<strong>in</strong>t<strong>in</strong>g. On <strong>the</strong> sec<strong>on</strong>d, its<br />

headquarters was broken <strong>in</strong>to, co<strong>in</strong>cid<strong>in</strong>g with a l<strong>on</strong>g <strong>in</strong>terrogati<strong>on</strong> carried out by <strong>the</strong><br />

daily with <strong>the</strong> wife <strong>of</strong> <strong>on</strong>e <strong>of</strong> an Islamic activist aga<strong>in</strong>st whom terrorism are brought 57 .<br />

In 2004, <strong>the</strong> m<strong>on</strong>thly "Po<strong>in</strong>t <strong>of</strong> View (Wojhat Nazar)" magaz<strong>in</strong>e was subject to such a<br />

practice when its pr<strong>in</strong>t<strong>in</strong>g <strong>of</strong>fice was raided <strong>and</strong> 8,000 copies were destroyed be<strong>for</strong>e<br />

distributi<strong>on</strong>, <strong>on</strong> <strong>the</strong> ground that it published a special file <strong>on</strong> <strong>the</strong> m<strong>on</strong>archy <strong>in</strong><br />

<strong>Morocco</strong>. The file <strong>in</strong>cluded a lecture delivered by <strong>the</strong> Pr<strong>in</strong>ce Moulay Hisham, <strong>the</strong><br />

K<strong>in</strong>g's cous<strong>in</strong>, at <strong>the</strong> French Internati<strong>on</strong>al Relati<strong>on</strong>s Institute <strong>on</strong> <strong>the</strong> "Family Code", as<br />

well as an article <strong>on</strong> <strong>the</strong> army <strong>in</strong> <strong>Morocco</strong>. The fr<strong>on</strong>t page <strong>of</strong> <strong>the</strong> c<strong>on</strong>fiscated issue<br />

showed a picture <strong>of</strong> K<strong>in</strong>g Mohammed VI <strong>and</strong> his cous<strong>in</strong>. After <strong>the</strong> magaz<strong>in</strong>e's<br />

manager resorted to court, a rul<strong>in</strong>g was pr<strong>on</strong>ounced compensat<strong>in</strong>g him <strong>for</strong> part <strong>of</strong> <strong>the</strong><br />

loss he <strong>in</strong>curred. In ano<strong>the</strong>r case, <strong>the</strong> weekly "al-Baydawi" was <strong>for</strong>ced, under pr<strong>in</strong>t, to<br />

change <strong>the</strong> cover's title, accord<strong>in</strong>g to what has been previously menti<strong>on</strong>ed <strong>in</strong> <strong>the</strong> said<br />

report.<br />

The precedent set by <strong>the</strong> French "Le Nouvel Observateur" magaz<strong>in</strong>e <strong>in</strong> March 2006 is<br />

worth noth<strong>in</strong>g <strong>in</strong> this regard. The magaz<strong>in</strong>e, after prepar<strong>in</strong>g <strong>the</strong> material <strong>of</strong> a file <strong>on</strong><br />

<strong>Morocco</strong>, sent <strong>the</strong> said file to <strong>the</strong> M<strong>in</strong>istry <strong>of</strong> Communicati<strong>on</strong>s, <strong>in</strong>quir<strong>in</strong>g if such<br />

material would cause any problems or not.<br />
