happen under <strong>the</strong> rule <strong>of</strong> K<strong>in</strong>g Hassan II with <strong>the</strong> current situati<strong>on</strong> under his successor<br />

K<strong>in</strong>g Mohammed VI. The report also tries to reveal if <strong>the</strong>re has been a shift from <strong>on</strong>e<br />

regime to ano<strong>the</strong>r.<br />

II- Chapter Two: Analysis <strong>of</strong> Pr<strong>in</strong>ciples<br />

1- Independence<br />

The c<strong>on</strong>cept <strong>of</strong> <strong>in</strong>dependence <strong>in</strong> media is still ambiguous <strong>in</strong> terms <strong>of</strong> def<strong>in</strong>iti<strong>on</strong>. The<br />

questi<strong>on</strong> raised was if <strong>in</strong>dependence meant <strong>in</strong>dependence from <strong>the</strong> State, political<br />

parties, capital or from all <strong>the</strong>se parties. In earlier phases, when <strong>the</strong> media <strong>of</strong> <strong>the</strong><br />

oppositi<strong>on</strong> was <strong>the</strong> first <strong>on</strong>e to compete with <strong>the</strong> <strong>of</strong>ficial media, <strong>the</strong> prevalent c<strong>on</strong>cept<br />

<strong>of</strong> <strong>in</strong>dependence meant <strong>in</strong> <strong>the</strong> first place <strong>in</strong>dependence vis-à-vis <strong>the</strong> State <strong>and</strong> its<br />

opti<strong>on</strong>s. However, <strong>the</strong> percepti<strong>on</strong> towards this c<strong>on</strong>cept rapidly changed when<br />

<strong>in</strong>dependent press emerged <strong>on</strong> <strong>the</strong> media arena. This press succeeded <strong>in</strong> break<strong>in</strong>g <strong>the</strong><br />

hegem<strong>on</strong>y imposed by <strong>the</strong> partisan press. The c<strong>on</strong>cept has become more <strong>and</strong> more<br />

related to "pr<strong>of</strong>essi<strong>on</strong>al c<strong>on</strong>siderati<strong>on</strong>s" 26 , which means "seek to serve <strong>the</strong> recipient<br />

via <strong>the</strong> media <strong>of</strong> truth <strong>and</strong> <strong>in</strong>tegrity."<br />

However, this visi<strong>on</strong> <strong>of</strong> <strong>the</strong> media's <strong>in</strong>dependence, even if it became clearer <strong>in</strong> <strong>the</strong><br />

rhetoric <strong>in</strong> <strong>the</strong> media, is fac<strong>in</strong>g some difficulties. Some <strong>of</strong> <strong>the</strong>se difficulties are related<br />

to <strong>the</strong> legal framework regulat<strong>in</strong>g <strong>the</strong> media <strong>in</strong> <strong>Morocco</strong>, as <strong>the</strong>re is c<strong>on</strong>tradicti<strong>on</strong><br />

between texts underl<strong>in</strong><strong>in</strong>g <strong>the</strong> freedom <strong>and</strong> <strong>in</strong>dependence <strong>of</strong> press <strong>and</strong> o<strong>the</strong>rs oppos<strong>in</strong>g<br />

this orientati<strong>on</strong>. O<strong>the</strong>r difficulties are l<strong>in</strong>ked to practice <strong>and</strong> <strong>the</strong> ambiguity <strong>of</strong> choices<br />

<strong>of</strong> political actors <strong>in</strong> terms <strong>of</strong> <strong>the</strong>ir visi<strong>on</strong> <strong>of</strong> media <strong>in</strong> <strong>Morocco</strong>. The precipitati<strong>on</strong>s <strong>of</strong><br />

<strong>the</strong> culture that prevailed dur<strong>in</strong>g <strong>the</strong> c<strong>on</strong>flict between <strong>the</strong> public media <strong>and</strong> <strong>the</strong><br />

oppositi<strong>on</strong>'s media are very present here.<br />

1-1 <strong>Media</strong> Independence Guarantees<br />

Whe<strong>the</strong>r <strong>in</strong> <strong>the</strong> C<strong>on</strong>stituti<strong>on</strong>, or <strong>in</strong> <strong>the</strong> <strong>Law</strong> <strong>of</strong> Press or o<strong>the</strong>r laws related to media,<br />

<strong>the</strong>re are guarantees that ei<strong>the</strong>r c<strong>on</strong>cern <strong>the</strong> freedom <strong>of</strong> speech <strong>in</strong> general or <strong>the</strong><br />

freedom <strong>of</strong> <strong>the</strong> press <strong>in</strong> particular, or even with <strong>the</strong> freedom <strong>of</strong> <strong>the</strong> journalists' <strong>and</strong><br />

media outlets associati<strong>on</strong>, or <strong>the</strong> right to access <strong>in</strong><strong>for</strong>mati<strong>on</strong>. However, <strong>the</strong>se<br />

guarantees f<strong>in</strong>d <strong>the</strong>mselves surrounded by o<strong>the</strong>r c<strong>on</strong>diti<strong>on</strong>s limit<strong>in</strong>g <strong>the</strong>m.<br />

1-1-1 Freedom <strong>of</strong> Speech<br />

The Moroccan C<strong>on</strong>stituti<strong>on</strong> guarantees <strong>the</strong> "freedom <strong>of</strong> op<strong>in</strong>i<strong>on</strong> <strong>and</strong> speech <strong>of</strong> all<br />

<strong>for</strong>ms" (Article 9). It also guarantees "<strong>the</strong> freedom <strong>of</strong> establish<strong>in</strong>g associati<strong>on</strong>, as well<br />

as <strong>the</strong> freedom to jo<strong>in</strong> any syndicate or any political organizati<strong>on</strong>." The C<strong>on</strong>stituti<strong>on</strong><br />

stresses that "curb<strong>in</strong>g <strong>the</strong> practice <strong>of</strong> <strong>the</strong>se freedoms could not occur except by virtue<br />

<strong>of</strong> <strong>the</strong> law."<br />

There are o<strong>the</strong>r legal texts regulat<strong>in</strong>g <strong>the</strong> practice <strong>of</strong> <strong>the</strong> menti<strong>on</strong>ed freedoms. For<br />

<strong>in</strong>stance, <strong>the</strong> public freedoms decree (zahir), that preceded <strong>Morocco</strong>'s entrance <strong>in</strong>to<br />
