In general, journalists associate <strong>in</strong> <strong>the</strong> Nati<strong>on</strong>al Uni<strong>on</strong> <strong>for</strong> <strong>the</strong> Moroccan Press, which<br />

is <strong>the</strong> <strong>on</strong>ly exist<strong>in</strong>g syndicate to date 49 . Yet, this does not mean that all <strong>of</strong> <strong>the</strong>m take<br />

part <strong>in</strong> its activities or bear membership cards.<br />

The Uni<strong>on</strong> had never compla<strong>in</strong>ed about c<strong>on</strong>stra<strong>in</strong>s aga<strong>in</strong>st its activities, at least dur<strong>in</strong>g<br />

<strong>the</strong> past years. The State provides <strong>the</strong> Uni<strong>on</strong> with headquarters. This is <strong>in</strong> additi<strong>on</strong> to<br />

an annual f<strong>in</strong>ancial cover as a support, which is part <strong>of</strong> <strong>the</strong> budget that is allocated<br />

under <strong>the</strong> f<strong>in</strong>ance law to support parties, syndicates <strong>and</strong> <strong>the</strong> nati<strong>on</strong>al press. The Statute<br />

<strong>for</strong> pr<strong>of</strong>essi<strong>on</strong>al journalists <strong>and</strong> <strong>the</strong> decree apply<strong>in</strong>g it guarantee <strong>the</strong> right <strong>of</strong><br />

representati<strong>on</strong>, <strong>in</strong> additi<strong>on</strong> to <strong>the</strong> governmental authority <strong>in</strong> charge <strong>of</strong> media <strong>and</strong><br />

representatives <strong>of</strong> media outlets, with "<strong>the</strong> press card committee that undertakes<br />

annually supervisi<strong>on</strong> <strong>of</strong> <strong>the</strong> distributi<strong>on</strong> <strong>of</strong> press cards <strong>and</strong> <strong>the</strong> task <strong>of</strong> c<strong>on</strong>trol <strong>of</strong> <strong>the</strong><br />

pr<strong>in</strong>ciples that <strong>the</strong> pr<strong>of</strong>essi<strong>on</strong>'s code <strong>of</strong> ethics should be based <strong>on</strong>" (Article 7).<br />

Except <strong>for</strong> <strong>the</strong> tug <strong>of</strong> war between <strong>the</strong> Uni<strong>on</strong> <strong>and</strong> <strong>the</strong> Communicati<strong>on</strong>s M<strong>in</strong>istry under<br />

<strong>the</strong> m<strong>and</strong>ate <strong>of</strong> <strong>for</strong>mer m<strong>in</strong>ister Mohammed Ashaari when <strong>the</strong> proposals <strong>of</strong> <strong>the</strong> Uni<strong>on</strong><br />

c<strong>on</strong>cern<strong>in</strong>g amendment <strong>of</strong> <strong>the</strong> Press <strong>Law</strong>, this Uni<strong>on</strong> was present <strong>in</strong> <strong>the</strong> debate <strong>on</strong><br />

re<strong>for</strong>m<strong>in</strong>g <strong>the</strong> Moroccan media, particularly <strong>the</strong> written press. The Uni<strong>on</strong> <strong>in</strong>itiated<br />

negotiati<strong>on</strong>s with <strong>the</strong> Communicati<strong>on</strong>s M<strong>in</strong>istry regard<strong>in</strong>g <strong>the</strong> amendments relative to<br />

<strong>the</strong> Press <strong>Law</strong>. It was also a major partner, whe<strong>the</strong>r <strong>in</strong> <strong>the</strong> nati<strong>on</strong>al media debate that<br />

saw <strong>the</strong> signature <strong>of</strong> "Agreement <strong>of</strong> <strong>the</strong> Debate- Program" or dur<strong>in</strong>g <strong>the</strong> preparati<strong>on</strong><br />

<strong>and</strong> signature <strong>of</strong> <strong>the</strong> collective agreement <strong>for</strong> pr<strong>of</strong>essi<strong>on</strong>al journalists. The latter<br />

stipulated am<strong>on</strong>g o<strong>the</strong>r th<strong>in</strong>gs <strong>for</strong> <strong>the</strong> "pr<strong>of</strong>essi<strong>on</strong>al journalists' right to practice<br />

syndical work <strong>in</strong> accordance with <strong>the</strong> labor code, <strong>and</strong> <strong>in</strong> a pluralistic framework <strong>and</strong><br />

without any discrim<strong>in</strong>ati<strong>on</strong>, with respect to <strong>the</strong> freedom <strong>of</strong> work <strong>and</strong> pr<strong>of</strong>essi<strong>on</strong>al<br />

c<strong>on</strong>science" (Article 18). It also stipulated that "every pr<strong>of</strong>essi<strong>on</strong>al journalist is<br />

entitled to have <strong>the</strong> support <strong>of</strong> an employees' representative or a syndical<br />

representative, that he chooses <strong>and</strong> who is a member <strong>of</strong> a syndicate that is legally<br />

represented <strong>in</strong>side <strong>the</strong> journalism field, <strong>in</strong> procedures <strong>of</strong> discipl<strong>in</strong>e <strong>and</strong> lay-<strong>of</strong>f as<br />

stipulated <strong>in</strong> <strong>the</strong> Labor Code (Article 18). It also gave <strong>the</strong> elected representatives <strong>and</strong><br />

members <strong>of</strong> syndical bureaus <strong>the</strong> right to benefit from legal facilities <strong>and</strong> protecti<strong>on</strong> <strong>in</strong><br />

order to per<strong>for</strong>m <strong>the</strong>ir tasks, to have a bullet<strong>in</strong> board at <strong>the</strong>ir disposal so that <strong>the</strong>y can<br />

per<strong>for</strong>m <strong>the</strong>ir tasks.<br />

This right which is guaranteed <strong>for</strong> journalists is guaranteed <strong>for</strong> journalistic outlets,<br />

most <strong>of</strong> which are part <strong>of</strong> <strong>the</strong> Moroccan Publishers Federati<strong>on</strong> that has become a<br />

major partner <strong>in</strong> everyth<strong>in</strong>g that has to do with <strong>the</strong> media <strong>in</strong> <strong>Morocco</strong>.<br />

1-1-4 The Right to have access to <strong>in</strong><strong>for</strong>mati<strong>on</strong><br />

The right to have access to <strong>in</strong><strong>for</strong>mati<strong>on</strong> is <strong>on</strong>e <strong>of</strong> <strong>the</strong> major difficulties fac<strong>in</strong>g <strong>the</strong><br />

media bus<strong>in</strong>ess <strong>in</strong> <strong>Morocco</strong>. The a<strong>for</strong>ementi<strong>on</strong>ed op<strong>in</strong>i<strong>on</strong> survey showed that although<br />

56% <strong>of</strong> those who answered agreed that journalists can obta<strong>in</strong> government <strong>and</strong> n<strong>on</strong>government<br />

documents at a rate <strong>of</strong> 70%, <strong>the</strong> government documents cannot be<br />

<strong>and</strong> TV, quit <strong>and</strong> established a syndicate affiliated with a trade-uni<strong>on</strong> (Democratic Labor<br />

C<strong>on</strong>federati<strong>on</strong>).
