Extreme caution must also be taken in regard <strong>to</strong> the issuance of the Certificate of<br />
Origin, so that it is correctly designed in compliance with the procedures required<br />
in the trade agreements signed by <strong>Brazil</strong>.<br />
Shipment procedures<br />
If the <strong>Brazil</strong>ian importer has <strong>to</strong> obtain the LI authorization prior <strong>to</strong> the shipment<br />
abroad, the exporter will have <strong>to</strong> be notified not <strong>to</strong> ship the goods before such<br />
authorization is granted. Otherwise, the <strong>Brazil</strong>ian importer will be subject <strong>to</strong> the<br />
fines that the <strong>Brazil</strong>ian law makes provision for.<br />
In the case of payment in advance, the buyer, in possession of the Pro Forma<br />
Invoice, will have <strong>to</strong> provide the foreign exchange contract <strong>to</strong> effect the remittance.<br />
If it is a payment through a collecting bank, the process is inverted, so that the<br />
exporter will have <strong>to</strong> first ship the goods and then send the documentation via the<br />
bank. In the case of a letter of credit, the buyer will use the Pro Forma Invoice <strong>to</strong><br />
process the operation with the <strong>Brazil</strong>ian bank. The characteristics of each of these<br />
forms of payment are discussed in section III.8.<br />
In all cases, the original documents required must reach the importer via the bank<br />
or directly at his address as soon as possible, so that cus<strong>to</strong>ms and nationalization<br />
procedures can be initiated. The documents basically consist of: the bill of lading<br />
(a document that proves possession or ownership of the goods and the engagement<br />
of a transportation opera<strong>to</strong>r); the commercial invoice (similar <strong>to</strong> the pro forma<br />
invoice, but issued after the shipping of the goods, mirroring the operation effected<br />
between the foreign exporter and the <strong>Brazil</strong>ian importer); the packing list (a list<br />
handed <strong>to</strong> the transporter by the exporter, which contains the description, quantity,<br />
brands, numbers and models of the goods <strong>to</strong> be transported); and the Certificate<br />
of Origin (if preferential tariff treatment has been applied for).<br />
It is recommended that the exporter send copies of these documents by fax, as<br />
some of the procedures can be anticipated while the goods are traveling <strong>to</strong> their<br />
destination, especially when this is done by air or land.<br />
In possession of the original documents and the goods in a primary or secondary<br />
zone cus<strong>to</strong>ms area, the <strong>Brazil</strong>ian importer can initiate the process known as import<br />
cus<strong>to</strong>ms expedition, via Siscomex, with a view <strong>to</strong> nationalizing the merchandise.<br />
III.4.4. Authorizing agencies<br />
With regard <strong>to</strong> inspection and permission for the entry of specific products in the<br />
cus<strong>to</strong>ms terri<strong>to</strong>ry of <strong>Brazil</strong>, several controlling agencies operate in the country. Their<br />
main concern is <strong>to</strong> analyze and authorize imports by means of the issuance of an<br />
