Except in the cases provided for by law, the beneficiary of this regime must sign a<br />

letter of responsibility assuming the payment of suspended taxes in the case of regime<br />

abuse. In the case of non-compliance with the conditions, requirements or periods<br />

established for the application of the regime, a fine corresponding <strong>to</strong> 10% of the<br />

cus<strong>to</strong>ms value of the goods is imposed.<br />

Depending on the purpose and value of the goods, it may be required <strong>to</strong> produce<br />

the guarantee for the suspended taxes, in addition <strong>to</strong> the signed letter of responsibility.<br />

III.9.3. Cus<strong>to</strong>ms warehouse<br />

The cus<strong>to</strong>ms warehouse special regime in import is one that allows the s<strong>to</strong>rage of<br />

foreign merchandise in a cus<strong>to</strong>ms facility of public use, with suspension of the payment<br />

of the taxes levied on the import. The regime also allows for the maintenance of the<br />

foreign merchandise in fairs, conferences, displays or similar events, held in a private<br />

facility, previously placed under cus<strong>to</strong>ms jurisdiction for that purpose.<br />

The great advantage of this regime is the possibility of partially nationalizing the<br />

merchandise as it is being sold.<br />

In addition <strong>to</strong> the s<strong>to</strong>rage operation, the imported or exported merchandise admitted<br />

in this regime may also undergo the following operations:<br />

• Display, demonstration and performance tests;<br />

• Industrialization;<br />

• Servicing or repair.<br />

III.9.4. Free warehouse<br />

The free warehouse special regime is one that allows the s<strong>to</strong>rage in a cus<strong>to</strong>ms facility<br />

of foreign merchandise <strong>to</strong> meet the trade flow between neighboring and third countries.<br />

This regime is only granted when authorized by an international agreement signed by<br />

<strong>Brazil</strong>. Although there are already agreements between <strong>Brazil</strong>, Paraguay and Bolivia,<br />

only the free warehouses of the ports of San<strong>to</strong>s and Paranaguá are in operation and<br />

are used by Paraguay for goods exported or imported by other countries.<br />

III.9.5. Triangular trade (Back-<strong>to</strong>-back credits)<br />

Known as back-<strong>to</strong>-back credits, this operation allows the importer <strong>to</strong> buy goods from<br />

an exporter with instructions that the products be shipped <strong>to</strong> a third country, without<br />

ever entering <strong>Brazil</strong>ian terri<strong>to</strong>ry.<br />
