Explanation <strong>of</strong> El- The abovG casG ill which Elmer br<strong>in</strong>gs an<br />

mer's Suit. action aga<strong>in</strong>st Holton and Bartlett, throws<br />

a little light npon the record <strong>of</strong> the first<br />

choice by the town <strong>of</strong> commissioners to end small causes.<br />

Three men were voted for, but the names <strong>of</strong> only two <strong>of</strong><br />

them were recorded. The f<strong>in</strong>d<strong>in</strong>g <strong>of</strong> the court <strong>in</strong>dicates<br />

that Edward Elmer was one <strong>of</strong> the commissioners chosen,<br />

and that for some unexpla<strong>in</strong>ed reason another ballot was<br />

taken and some one else elected. Elmer it seems, <strong>in</strong> order<br />

to secure the <strong>of</strong>fice, lost no time before tak<strong>in</strong>g the oath.<br />

Holton and Bartlett undoubtedly censured him for this unseemly<br />

haste, call<strong>in</strong>g it disorderly. The records conta<strong>in</strong> no<br />

solution <strong>of</strong> the matter, as the court was not called upon to<br />

decide the legality <strong>of</strong> the election, and no mention is made<br />

<strong>of</strong> the third man chosen on the board <strong>of</strong> commissioners<br />

but Elmer undoubtedly acted.<br />
