that <strong>the</strong> new State has not yet<br />

succeeded to <strong>the</strong> property <strong>of</strong> <strong>the</strong><br />

Russian imperial realm, that, on<br />

<strong>the</strong> contrary, all movable national<br />

values have been carried to St.<br />

Petersbui'g by <strong>the</strong> Government<br />

<strong>of</strong> Great Russia.<br />

If in spite <strong>of</strong> all this it was<br />

found possible to recognize and<br />

accept <strong>the</strong> principle <strong>of</strong> compensation<br />

for civilian damages, this<br />

must be attributed to <strong>the</strong> sense<br />

<strong>of</strong> right and fairness by which<br />

<strong>the</strong> interested delegations were<br />

equally animated. It seemed impossible<br />

that <strong>the</strong> wrong could<br />

have been left unatoned which<br />

had been caused by hateful special<br />

laws to <strong>the</strong> <strong>peace</strong>ful private<br />

individuals, through unlawful<br />

measures on <strong>the</strong> part <strong>of</strong> <strong>the</strong> authorities<br />

or through acts <strong>of</strong> violence<br />

on <strong>the</strong> part <strong>of</strong> <strong>the</strong> population<br />

without any necessity <strong>of</strong> war.<br />

It goes without saying that <strong>the</strong><br />

Germans who had suffered<br />

war<br />

damages in <strong>the</strong> Ukraine could as<br />

little expect to receive absolute<br />

compensation, as this is <strong>the</strong> case<br />

for <strong>the</strong> Germans in <strong>the</strong>ir homeland.<br />

Article 13, <strong>the</strong>refore, restricts<br />

<strong>the</strong> claim for compensation<br />

to those damages which private<br />

individuals have sustained<br />

in consequence <strong>of</strong> war laws by<br />

reason <strong>of</strong> temporary or permanent<br />

subtraction <strong>of</strong> copyright,<br />

industrial patents, concessions,<br />

privileges, and similar claims (see<br />

Article 9), or as a result <strong>of</strong> <strong>the</strong><br />

supervision, safe-guarding, administration,<br />

or alienation <strong>of</strong> objects<br />

<strong>of</strong> property (see Article 11),<br />

arid puts such damages on a par<br />

with those which, during <strong>the</strong> war,<br />

and without <strong>the</strong> war areas have<br />

been caused by <strong>the</strong> national authorities<br />

and by <strong>the</strong> population<br />

<strong>of</strong> <strong>the</strong> o<strong>the</strong>r party through acts <strong>of</strong><br />

violence against <strong>the</strong> body, health,<br />

or property <strong>of</strong> <strong>the</strong> individual and<br />

contrary to international law. In
