facilitating both exportation from<br />

and importation into Russia, according<br />

to <strong>the</strong> needs <strong>of</strong> commerce.<br />

At <strong>the</strong> same time <strong>the</strong> freight<br />

rates for goods which in <strong>the</strong><br />

Russian railway tariff are classed<br />

under <strong>the</strong> category <strong>of</strong> cereals, and<br />

on flax and hemp, from <strong>the</strong><br />

stations <strong>of</strong> departure <strong>of</strong> <strong>the</strong><br />

Russian railways to <strong>the</strong> abovementioned<br />

ports, shall be determined<br />

and divided between <strong>the</strong><br />

Russian and German railways<br />

over which <strong>the</strong> goods are transported,<br />

according to <strong>the</strong> regulations<br />

which are or shall be in<br />

force for <strong>the</strong> Russian railways to<br />

<strong>the</strong> ports <strong>of</strong> Libau and Riga.<br />

The additional charges (incidental<br />

fees) levied in excess <strong>of</strong> <strong>the</strong><br />

freight rates shall in like manner<br />

be determined, and <strong>the</strong> amount<br />

<strong>the</strong>re<strong>of</strong> be divided among <strong>the</strong><br />

interested lines, according to<br />

Russian regulations, it being<br />

understood that one frontier fee<br />

only shall be levied, which shall<br />

be divided equally between <strong>the</strong><br />

German and Russian railways<br />

terminating at <strong>the</strong> frontier.<br />

This obligation only concerns<br />

<strong>the</strong> railways <strong>of</strong> <strong>the</strong> two countries;<br />

but <strong>the</strong> two Governments will<br />

exert <strong>the</strong>ir efforts to <strong>the</strong> end that<br />

private railways may apply on<br />

<strong>the</strong>ir lines <strong>the</strong> same principles for<br />

<strong>the</strong> establishment <strong>of</strong> <strong>the</strong> rates and<br />

<strong>the</strong> division <strong>of</strong> <strong>the</strong> freight. If,<br />

notwithstanding, <strong>the</strong> private lines<br />

concerned in traffic in one <strong>of</strong> <strong>the</strong><br />

indicated directions do not submit<br />

to <strong>the</strong> rates and divisions<br />

mentioned, <strong>the</strong>se regulations shall<br />

cease to be obligatory on <strong>the</strong><br />

State railways <strong>of</strong> <strong>the</strong> two contracting<br />

Powers.<br />

The existing provisions for regulating<br />

competitive traffic between<br />

Koenigsberg and Danzig remain<br />

in force.
