INTERPRETATION AND GENERAL<br />
the extraction has taken place.However borrow pits<br />
outside the area where construction will take place<br />
are covered by these quarry regulations.<br />
A quarry does not include a mine; a public road; or<br />
a railway line. Also a quarry does not include<br />
prospecting, extraction or preparation for sale of<br />
minerals extracted by boreholes such as oil <strong>and</strong> gas.<br />
Demarcation<br />
Dividing a quarry into areas where the Quarries<br />
Regulations apply <strong>and</strong> other areas where they do<br />
not, may, in some cases, cause confusion. In such<br />
cases the operator may find it more convenient to<br />
treat the whole quarry site as being subject to the<br />
Quarries Regulations. Demarcation is at the discretion<br />
of the operator, however additional legal<br />
requirements may also be applicable to some activities<br />
<strong>and</strong> must be considered.<br />
Areas that the operator deems that the Quarries<br />
Regulations do not apply should be clearly marked<br />
on a site plan <strong>and</strong> the plan should be included in the<br />
safety statement <strong>and</strong> arrangements for coordinating<br />
safety <strong>and</strong> health between the operator<br />
<strong>and</strong> the occupants of any excluded areas should be<br />
explained in the safety statement.<br />
The Quarries Regulations apply to sites while<br />
minerals are extracted for a further use as part of<br />
another process, such as reclamation.<br />
Rail lines operated by a railway company are not legally<br />
part of a quarry; however,any part of a railway system<br />
that a quarry operates itself forms part of the quarry.<br />
Application<br />
(Regulation 4)<br />
(1) Subject to paragraph (2), these Regulations<br />
apply to all quarries.<br />
(2) These Regulations do not apply to a quarry<br />
in relation to which -<br />
(a) notice of permanent cessation of quarrying<br />
operations has been given to the <strong>Authority</strong><br />
in accordance with Regulation 8, <strong>and</strong><br />
(b) all work relating <strong>and</strong> incidental to that<br />
cessation has been completed, including<br />
work for the purpose of preventing the<br />
escape from that quarry of water or other<br />
substance that flows when wet.<br />
(3) The relevant statutory provisions apply to all<br />
quarries, without prejudice to more stringent or<br />
specific provisions contained in these Regulations.<br />
Amendment of <strong>Safe</strong>ty, <strong>Health</strong> <strong>and</strong> Welfare at Work<br />
(Extractive Industries) Regulations 1997.<br />
(Regulation 5)<br />
The <strong>Safe</strong>ty, <strong>Health</strong> <strong>and</strong> Welfare at Work<br />
(Extractive Industries) Regulations 1997 (S.I. No.<br />
467 of 1997) are amended by inserting after<br />
Regulation 3 the following Regulation:<br />
“Non-application to quarries<br />
3A.Notwithst<strong>and</strong>ing Regulations 2(1) <strong>and</strong> 3,<br />
these Regulations shall not apply to a quarry<br />
within the meaning of the <strong>Safe</strong>ty, <strong>Health</strong> <strong>and</strong><br />
Welfare at Work (Quarries) Regulations 2008.”.<br />
