15. RECORD KEEPING<br />
(Regulation 18)<br />
18.<br />
(1) The operator shall ensure that -<br />
(a) every report, notification or other record required<br />
to be made under these Regulations<br />
is in an approved, or otherwise appropriate,<br />
form <strong>and</strong> kept at the quarry or other suitable<br />
place, but when quarrying operations<br />
have permanently ceased at the quarry the<br />
record shall be kept -<br />
(i) at the registered office of the operator, or<br />
(ii) where the operator is an individual, at his or<br />
her place of business for a period of 6 years,<br />
unless the provision concerned imposes a<br />
different period, <strong>and</strong><br />
(b) a copy of the written statement of duties of<br />
all persons appointed at the quarry under<br />
these Regulations is kept at the quarry or<br />
other suitable place for at least one year<br />
from the date of termination of the person’s<br />
employment.<br />
(2) Subject to paragraph (1), where under these<br />
Regulations records, reports, or other documents<br />
are required to be made, it is sufficient<br />
compliance with the requirement if the operator<br />
<strong>and</strong>, where appropriate, other person concerned -<br />
(a) make <strong>and</strong> maintain the record, report or<br />
other document by electronic means, <strong>and</strong><br />
(b) duly authenticate it as soon as is practicable<br />
afterwards.<br />
(3) Without prejudice to section 64 of the Act, any<br />
person having custody of the records required by<br />
the Act or these Regulations shall -<br />
(a) ensure that the records are open to<br />
inspection by an inspector, <strong>and</strong><br />
(b) forthwith send to an inspector such extracts<br />
from them or copies of them as the<br />
inspector may from time to time require in<br />
accordance with section 64 of the Act.<br />
The information contained in records required to be<br />
kept by the quarry operator must be kept available<br />
for six years.This provides data from which operators<br />
can identify <strong>and</strong> monitor trends <strong>and</strong> make judgements,<br />
for example, about plant maintenance. The<br />
retention of records also enables them to be<br />
examined by <strong>Health</strong> <strong>and</strong> <strong>Safe</strong>ty <strong>Authority</strong> Inspectors.<br />
The way in which records are made <strong>and</strong> stored is left<br />
to the discretion of the operator, but the information<br />
needs to be stored accurately <strong>and</strong> to be easily<br />
retrievable.Records may be kept electronically (with<br />
suitable back up arrangements) or on paper.<br />
The records may be kept at the quarry or other<br />
suitable place,provided that anyone who has a right<br />
to see them can readily obtain them,for example,by<br />
electronic transmission. Records required include:<br />
Notifications to the <strong>Authority</strong> required by these<br />
regulations<br />
Daily <strong>and</strong> periodic inspection records;<br />
Examinations for flammable/explosive<br />
atmospheres;<br />
Appointments of<br />
1. <strong>Quarry</strong> manager;<br />
2. Manager, supervisors, etc;<br />
3. Explosives supervisors;<br />
4. Shotfirers, storekeepers, etc.<br />
Blasting specifications, including drilling logs,<br />
<strong>and</strong> any face profile results;<br />
Any misfires including details of remedial<br />
action taken;<br />
The conclusion of geotechnical appraisals, site<br />
investigations <strong>and</strong> assessments;<br />
Reports of thorough examination of any lifting<br />
gear or lifting appliance;<br />
Reports of thorough examination of any<br />
compressor, air receiver or steam boiler;<br />
Results of vehicle brake tests;<br />
Records of inspection <strong>and</strong> maintenance of<br />
equipment;<br />
Copies of any relevant certificate or registration<br />
card issued by a recognised bodies for any<br />
person operating equipment or carrying out<br />
operations listed in Schedule 1 to the<br />
Regulations;<br />
Certification of inspection of electrical<br />
installations;<br />
Copies of permit to work documentation.<br />
Other documents are also required which are to be<br />
included in the safety statement such as the<br />
management structure, instructions, rules <strong>and</strong> safe<br />
operating procedures, shotfiring rules, vehicle rules,<br />
<strong>and</strong> emergency procedures. These are required to<br />
be available <strong>and</strong> up to date.<br />
