planning activities already referred to. It must also<br />

include any sub-contractors who have significant roles<br />

in the management of the quarry. The management<br />

structure must be set out in writing <strong>and</strong> included in<br />

the safety statement.<br />

A competent person must be appointed as quarry<br />

manager to manage the operation of the quarry at all<br />

times when work is being undertaken.If the operator<br />

is a competent individual he or she could also be the<br />

quarry manager.There is no requirement to notify the<br />

<strong>Authority</strong> of the appointment of the quarry manager.<br />

Arrangements should be in place for cover during<br />

absences of the quarry manager <strong>and</strong> other key<br />

personnel,for example,during sick leave,holiday leave<br />

etc. Everyone working at the quarry needs to know<br />

who the manager is. The quarry manager is the<br />

operator’s representative at the quarry <strong>and</strong> it is his or<br />

her role to advise <strong>and</strong> assist the operator to fulfil all<br />

legal requirements. The appointment of a quarry<br />

manager does not take away the legal duty of the<br />

operator to fulfil his or her statutory functions but<br />

provides for a point of contact to the contractors,selfemployed<br />

persons at the quarry <strong>and</strong> the operator’s<br />

employees.The quarry manager <strong>and</strong> other persons in<br />

the management structure can be held accountable<br />

for their acts or omissions, or any offence committed<br />

with their consent, connivance or neglect under the<br />

<strong>Safe</strong>ty, <strong>Health</strong> <strong>and</strong> Welfare at Work Act 2005 (See<br />

Sections 80 & 81 of that Act).<br />

The entire workforce needs to underst<strong>and</strong> their responsibilities<br />

<strong>and</strong> authority in relation to safety <strong>and</strong> health.<br />

They also need to know how their responsibilities interrelate<br />

with those of others.It is normally best if the key<br />

responsibilities are summarised in the management<br />

structure with more detail being provided in the<br />

individual job descriptions.<br />

It is particularly important that managers <strong>and</strong> supervisors<br />

properly underst<strong>and</strong> their safety <strong>and</strong> health<br />

responsibilities <strong>and</strong> authority. They must also be<br />

competent to do their job so that others are not put at<br />

risk. The type <strong>and</strong> degree of competence will vary<br />

from quarry to quarry <strong>and</strong> from job to job. In some<br />

cases particular qualifications are needed,for example,<br />

where explosives are used.<br />

The management structure should include any senior<br />

managers off-site who are responsible for safety <strong>and</strong><br />

health, as well as managers <strong>and</strong> supervisors working<br />

at the quarry. Where the operator is also the quarry<br />

manager, then the management structure may be<br />

very simple. In other companies the structure may<br />

be more complex, but the structure should always<br />

make it clear where responsibilities lie.<br />

The management structure must be reviewed<br />

routinely <strong>and</strong>,in particular,where the work or people<br />

change significantly,to ensure that it remains appropriate.<br />

Operators need to inform the workforce<br />

about the management structure.The legal responsibility<br />

for the overall control of the quarry rests on<br />

the operator <strong>and</strong> not on an individual manager or<br />

supervisor appointed to take charge on site – unless<br />

that individual is the operator.<br />

A sample management structure for a reasonably<br />

large quarry operation is shown overleaf in Figure 2<br />
