25.4 Privates Drives<br />
<strong>Preston</strong> <strong>Township</strong>, <strong>Wayne</strong> <strong>County</strong><br />
Subdivision and Land Development Ordinance<br />
exist in the adjacent neighborhood or if they would be deemed necessary to provide<br />
access to community facilities such as schools, shopping areas, or recreation areas.<br />
This shall be determined by the Board of Supervisors during or before the preliminary<br />
plan submission. Sidewalks and curbs shall be constructed to the specifications of the<br />
Pennsylvania Department of Transportation for the material chosen by the applicant and<br />
agreed to by the Board of Supervisors.<br />
Private driveways to be owned in common or individually by the prospective lot owners may be<br />
used to access a maximum of three (3) single-family dwellings. The following standards shall apply<br />
to private driveways:<br />
25.4.1 Individual driveways serving only one single-family dwelling, or two such dwellings in the<br />
case of shared driveways, shall not be subject to any of the street design or improvement<br />
requirements of this Ordinance or the <strong>Township</strong> Road Ordinance, provided that, in the<br />
case of two dwellings, the deed for each lot (a copy of which shall be submitted) shall<br />
contain appropriate restrictive covenants;<br />
25.4.1.1 setting forth the manner in which the costs of repairs, upgrade and<br />
maintenance shall be apportioned between the owners,<br />
25.4.1.2 restricting each parcel from further subdivision,<br />
25.4.1.3 providing for the maintenance of a minimum right-of-way of fifty (50) feet in<br />
width for said driveway, and<br />
25.4.1.4 documenting that the parties understand the driveway is the not the<br />
responsibility of the <strong>Township</strong> and that they have no recourse to the <strong>Township</strong><br />
for repairs, upgrades or maintenance unless and until said driveway is<br />
brought completely up to then prevailing road dedication requirements of<br />
<strong>Preston</strong> <strong>Township</strong> and is accepted by the Board of Supervisors.<br />
25.4.2 Standards of construction for other shared driveways servicing up to three (3) singlefamily<br />
dwellings may be modified provided;<br />
25.4.2.1 the deed for each lot (a copy of which shall be submitted) shall contain<br />
appropriate restrictive covenants meeting the requirements of § 25.4.1<br />
immediately above,<br />
25.4.2.2 the driveway shall meet the following minimum design standards:<br />
