property if levied assessments are not paid. The POA must also have the ability to adjust the<br />
assessment to meet changing needs.<br />
42.7 Trail Requirements. All lots and dwelling units shall have direct access to the open space provided<br />
in a conservation subdivision and there shall be a system of marked and/or improved trails<br />
developed to connect the open spaces with each other and with individual lots and dwelling units.<br />
42.8 Density Bonus. If the permanent open space created by the conservation subdivision technique is<br />
in active agricultural use for the raising of farm animals or crops (not including forestry) and this<br />
use is continued and protected by an easement for this purpose, the total number of dwelling units<br />
permitted in the conservation subdivision may be increased by up to 20%. A similar bonus will be<br />
provided in those instances where no new lots are created along an existing public highway, but<br />
rather are fronted on interior or marginal access streets.<br />
