§ 35 Commercial and Industrial Subdivisions and Other Land Developments - Generally<br />
35.1 Application.<br />
<strong>Preston</strong> <strong>Township</strong>, <strong>Wayne</strong> <strong>County</strong><br />
Subdivision and Land Development Ordinance<br />
All commercial and industrial subdivisions and land developments shall conform with the provisions<br />
of the applicable section(s) of this Ordinance. Notwithstanding any requirements that may exist<br />
under the Pennsylvania Municipalities Planning Code to submit an application for approval, the<br />
land development standards contained herein shall not, however, apply to the following:<br />
35.1.1 Temporary or accessory activities.<br />
35.1.2 Minor building alterations, repairs or maintenance activities.<br />
35.1.3 Conversion of single-family dwellings to two-family dwellings.<br />
35.1.4 Replacement, rehabilitation or reconstruction of a structure or facility for the same use at<br />
the same scale.<br />
35.1.5 Construction of any non-residential structure of less than one-thousand (1,000) square<br />
feet in floor area that does not involve any of the activities specifically regulated herein.<br />
These standards contained herein shall also not apply to new commercial agricultural land<br />
developments that involve the husbandry, at any one time, of less than one-hundred (100) livestock<br />
units or one (1) livestock unit per acre of land; or to animals raised for 4-H or other youth club<br />
activities. Where new commercial agricultural land developments exceed both these thresholds<br />
they shall be subject to review hereunder. A livestock unit shall consist of any one of the following<br />
and livestock units for non-specified animals shall be calculated based on similarity to those that<br />
are specified:<br />
One (1) hog;<br />
One (1) large animal (cows, sheep, goats, deer, etc.);<br />
Five-hundred (500) poultry;<br />
Three-hundred (300) other small animals (rabbits, chinchillas, mink, etc.).<br />
The above list is intended to clarify, in terms of their practical application, the exceptions already<br />
provided under the Pennsylvania Municipalities Planning Code. No person is exempted from the<br />
demands to file any plan required under such Code regardless whether or not standards for the<br />
same have been included in this Ordinance.<br />
35.2 Procedure. Commercial, industrial and other non-residential land developments shall comply fully<br />
with the procedures set forth in Article III of this Chapter, "Procedures, Plans and Improvement<br />
Requirements," regardless whether or not any actual conveyance of land by metes and bounds or<br />
other means is involved. Plans for new or expanded commercial, industrial or other non-residential<br />
developments shall be prepared and submitted for review and approval in the same manner as<br />
plans for subdivisions.<br />
