Real Estate Market Review 2011 | Latvia Tax Summary<br />

VALUE ADDED TAX<br />

Sale of l<strong>and</strong> is VAT-exempt, as is the sale of <strong>real</strong> <strong>estate</strong> in use.<br />

However, sale of unused <strong>real</strong> <strong>estate</strong> (buildings <strong>and</strong> constructions)<br />

<strong>and</strong> development l<strong>and</strong> (l<strong>and</strong> granted a building permit) is subject<br />

to VAT of 22 per cent. The combined sale of unused <strong>real</strong> <strong>estate</strong><br />

<strong>and</strong> all or part of the underlying l<strong>and</strong> cannot be separated for<br />

VAT to be applied only to the unused <strong>real</strong> <strong>estate</strong> sale value.<br />

Acquisition of <strong>real</strong> <strong>estate</strong> that has been subject to VAT should be<br />

registered with the taxation authorities <strong>and</strong> over the next ten<br />

years deducted input VAT corrections are made in case of<br />

changes in the percentage of taxable use.<br />

TRANSFER STAMP DUTY<br />

A stamp duty of 2 per cent normally applies to the sale price on<br />

transfer of title to <strong>real</strong> <strong>estate</strong>. Duty is capped at LVL 30,000<br />

(approx EUR 42,700). Duty does not apply to mergers <strong>and</strong> other<br />

restructurings. A 1 per cent duty applies to investments in kind<br />

of <strong>real</strong> <strong>estate</strong> in the share capital of a company, the duty is<br />

capped at LVL 1,000 (approx EUR 1,400). The duty for registering<br />

a mortgage is 0.1 per cent of the loan amount <strong>and</strong> is capped at<br />

LVL 1,000.<br />

Rental of residential premises to individuals is VAT-exempt,<br />

whereas rental payments for commercial property are subject<br />

to 22 per cent VAT.<br />
