TOPIC DESCRIPTION AUTHORIZATION TO ENTER INTO A TAKEOVER AGREEMENT WOODBRIDGE HIGH SCHOOL MODERNIZATION PROJECT On March 17, 2009, the Board of Education awarded the contract for Bid Package #2-1, Demo and Abatement, to ATE Environmental, Inc. for the Woodbridge High School Modernization project. ATE Environmental, Inc.’s license to contract was suspended by the Contractors State License Board in November of 2009 which ultimately led to ATE Environmental Inc.’s default on the contract on December 16, 2009. Lincoln General Insurance Company, as surety for the contractor, willingly undertook the completion of the contract on December 17, 2009 under the Performance Bond No. 661122101 issued for this project. The progress schedule on the project to date has not been affected by the default of the contractor and/or the subsequent takeover by the surety. In order for the surety to be paid contract funds due on this project a Takeover Agreement was required by the Orange County Department of Education legal department. Staff has negotiated the required agreement and it is ready for acceptance by the Board of Education. This agreement does not alter any of the terms and/or conditions of the original contract. It merely clarifies the authorized party to any contractual funds remaining on the contract, including any change orders. FISCAL IMPACT RECOMMENDATION None Authorize the Assistant Superintendent/CFO of Business Services to enter into a Takeover Agreement with Lincoln General Insurance Company, as surety for ATE Environmental, Inc. under Performance Bond No. 661122101 on the Woodbridge High School Modernization project. TOPIC DESCRIPTION CHANGE ORDERS WOODBRIDGE HIGH SCHOOL MODERNIZATION PROJECT Certain modifications were required during the construction phase of the Woodbridge High School Modernization project, which require a change order. A list of each item, the requesting party, a brief explanation of the reason for the change and the cost of the change is available in the Facilities office upon request. The following list contains the bid category, contractor, change order amount, and cumulative percentage of contract. The cumulative total of the change orders to any of the contractors listed below is within the 10% allowed by the Public Contract Code.
