Item No. 15 a. TOPIC DESCRIPTION SOLAR PROJECT UPDATE On December 8, 2009, the Irvine Unified School District and Sun Edison entered into a Solar Power Services and Site Lease Agreement. As part of this agreement, the District will incur no upfront construction or installation costs for placement of the solar photovoltaic systems. Sun Edison will own and operate the solar power systems and the District will purchase solar services generated by the systems at a set price comparable to or below current retail rates. The District will lease a portion of its property on selected sites to Sun Edison, which will, at its own cost, design, construct, install, operate and maintain solar photovoltaic systems. Since December, District staff, SPG Solar, and Sun Edison have evaluated selected sites for placement of solar photovoltaic systems. As part of this process, it has been determined that the rooftop on some of the sites is not appropriate for a solar photovoltaic system. As a result, other options for the installation of solar panels have been explored. Specifically, the installation of carports at some sites within the District has been considered as well as the installation of a ground-mounted system at one site. Public Information Nights were held on April 14, 21, and 28 to allow the community the opportunity to see proposed design plans for each site where solar photovoltaic systems could be installed. In addition, these design plans have been posted to the District’s website along with a form for community feedback. FISCAL IMPACT RECOMMENDATION None at this time. Review the proposed installation of solar photovoltaic systems at various sites. TOPIC DESCRIPTION RESOLUTION NO. 09-10-72: AUTHORIZING THE BORROWING OF FUNDS FOR FISCAL YEAR 2010-11 AND THE ISSUANCE AND SALE OF ONE OR MORE SERIES OF 2010-11 TAX AND REVENUE ANTICIPATION NOTES THEREFOR IN AN AMOUNT NOT TO EXCEED $25,000,000 AND PARTICIPATION IN THE SOUTH COAST LOCAL EDUCATION AGENCIES POOLED TAX AND REVENUE ANTICIPATION NOTE PROGRAM AND REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY TO ISSUE AND SELL SAID NOTES Each year the District must determine if there is a need to borrow cash for operations resulting from state revenues deferrals and district expenditure patterns. Due to IUSD’s basic aid status, the majority of revenues are from property tax proceeds which are collected in December and April. Consequently, in anticipation of future receipts the District must issue debt early in its fiscal year and pay it back in the latter portion of the fiscal year. The District will be issuing the debt instrument from within a pool of Orange County school districts (“South Coast Local Education Agencies Pooled Tax and Revenue Anticipation Note Program”). The resolution before the Board authorizes a sale of not to exceed $25 million during June, 2010. The resolution further approves the execution of a Trust Agreement and a Purchase Agreement and authorizes use of a Preliminary Official. FISCAL IMPACT RECOMMENDATION None Adopt Resolution No. 09-10-72 authorizing issuance, approving the Official Statement, and pledging revenues and entering into certain tax covenants in connection with the 2010-11 Tax and Revenue Anticipation Note (TRAN).
