problem related to <strong>the</strong> keeping of <strong>the</strong> Register is that <strong>the</strong> employees who make entries in it do not<br />

update <strong>the</strong> data and do not enter <strong>the</strong> in<strong>for</strong>mation correctly.<br />

The most often sent notices to <strong>the</strong> executives of structures at central level are related to <strong>the</strong><br />

violation of <strong>the</strong> terms <strong>for</strong> reflecting <strong>the</strong> changes in <strong>the</strong> in<strong>for</strong>mation in accordance with <strong>the</strong><br />

requirements of <strong>the</strong> Regulation <strong>for</strong> keeping <strong>the</strong> Register, During <strong>the</strong> last year <strong>the</strong>re were established<br />

two or more violations in <strong>the</strong> Ministry of Regional Development and <strong>Public</strong> Works, <strong>the</strong> Ministry of<br />

Transport and Communications, and <strong>the</strong> Ministry of Labour and Social Policy.<br />

Concerning <strong>the</strong> territorial administrations, <strong>the</strong> notices most often sent to <strong>the</strong> executives have<br />

been related to <strong>the</strong> violation of <strong>the</strong> terms <strong>for</strong> updating <strong>the</strong> in<strong>for</strong>mation, while in <strong>the</strong> municipal<br />

administrations – failure to update <strong>the</strong> names of mayors, deputy mayors and secretaries, <strong>the</strong> total<br />

number of staff and <strong>the</strong> vacancies, as well as incorrect entries of job position and reflection of <strong>the</strong><br />

hierarchical subordination of <strong>the</strong> administrative units.<br />

In <strong>2004</strong>, two or more violations have been established <strong>for</strong> 4 regional administrations (Varna,<br />

Veliko Tarnovo, Pleven and Smoljan), 20 municipal administrations and 4 administrations of<br />

municipal regions (regions Vazrazhdane, Krasno selo, Nadezda and Novi Iskar of Sofia<br />

municipality). More than twice have been sent notices to <strong>the</strong> employees from <strong>the</strong> municipal<br />

administrations Avren, Banite, Godech, Garmen, Dospat, Ihtiman, Kainardza, Pordim, Pravetz, Rila,<br />

sadovo, Svoge and Ugarchin, <strong>the</strong>y still have not entered <strong>the</strong> complete in<strong>for</strong>mation <strong>the</strong>y are obliged<br />

to enter into <strong>the</strong> Register.<br />

For <strong>the</strong> five years from <strong>the</strong> creation of <strong>the</strong> Register, it is only municipal administration<br />

Ihtiman that has never made any entry of in<strong>for</strong>mation into it.<br />

Actions on <strong>the</strong> part of <strong>the</strong> officials executing control on <strong>the</strong> entries into <strong>the</strong> Register and <strong>the</strong><br />

executives of administrative structures have been undertaken only in 6 structures at central level.<br />

The measures undertaken by <strong>the</strong>m <strong>for</strong> eliminating <strong>the</strong> deficiencies vary between remark and<br />

discussions with <strong>the</strong> persons responsible to make entries, nomination of ano<strong>the</strong>r employee to notice<br />

and dismissal of <strong>the</strong> officials (<strong>the</strong> State Commission <strong>for</strong> <strong>the</strong> Hazard).<br />

At territorial level it is only in 23 structures (2 regional administrations and 21 municipal<br />

ones) that measures have been undertaken by <strong>the</strong> persons executing control on <strong>the</strong> entries.<br />

Concerning <strong>the</strong> municipal administrations in which system violations of <strong>the</strong> Regulation have<br />

been established it was only <strong>the</strong> mayor of municipality Tutrakan who had undertaken actions <strong>for</strong><br />

imposing disciplinary sanction. No measures have been undertaken by <strong>the</strong> persons exercising<br />

control or <strong>the</strong> executives of <strong>the</strong> regional administrations and <strong>the</strong> administrations of <strong>the</strong> municipal<br />

regions where <strong>the</strong> employees failed to fulfill <strong>the</strong>ir obligations related to <strong>the</strong> entries into <strong>the</strong> Register.<br />

In general, at territorial level <strong>the</strong> measures undertaken are remark, discussions and replacement of<br />

<strong>the</strong> officials responsible <strong>for</strong> <strong>the</strong> entries.<br />

Problems of technical nature, unstable Internet connection (municipalities Banite, Godech)<br />

and insufficient capacity of human resources (municipality Apriltzi) are <strong>the</strong> motives of <strong>the</strong> executives<br />

not to undertake actions <strong>for</strong> sanctioning <strong>the</strong> employees.<br />

In March <strong>2004</strong> <strong>the</strong> solving of <strong>the</strong> problem <strong>for</strong> <strong>the</strong> computer provision of <strong>the</strong> territorial<br />

administrations <strong>for</strong> keeping <strong>the</strong> Register has been assisted through <strong>the</strong> centralized supply of<br />

computers, bought with <strong>the</strong> financial support of <strong>the</strong> a Phare 2001 project <strong>for</strong> all municipal<br />

administrations and administrations of municipal regions. With <strong>the</strong> contract signed between <strong>the</strong><br />

Minister of State <strong>Administration</strong> and <strong>the</strong> mayors <strong>the</strong> latter have undertaken to provide <strong>the</strong><br />

computers to <strong>the</strong> employees keeping <strong>the</strong> Register. However <strong>the</strong>re are cases of computers that are<br />

not used <strong>for</strong> <strong>the</strong> purpose.<br />

The officials or employees who exercise control on <strong>the</strong> entries into <strong>the</strong> Register from 179<br />

structures of <strong>the</strong> administration at central level and 252 structures at territorial level have noted no<br />

violations and this is contributing to <strong>the</strong> improvement of <strong>the</strong> transparency in <strong>the</strong> work of <strong>the</strong><br />

administration.<br />

The basic difficulties faced by <strong>the</strong> employees in <strong>the</strong> central administration when dealing with<br />

<strong>the</strong> Register are most frequently related to <strong>the</strong> use of <strong>the</strong> possibility <strong>for</strong> centralized provision of legal<br />

in<strong>for</strong>mation.<br />
