The <strong>Clean</strong> <strong>Sweep</strong> Report41. LAND DISPOSAL RESTRICTIONS AND TREATMENT STANDARDSThe Contractor shall comply with all aspects of state and EPA land disposal restrictions and treatment standards.The Contractor is responsible for the preparation of all land disposal restriction documentation which will beverified by the Department.42. ADDITIONALWASTESThe Department shall determine if additional wastes will be accepted at each collection location. If so, Contractorshall weigh the additional wastes and immediately inform the Department.43. INVOICINGA. Contractor shall provide an original and two (2) copies of invoices to the Department.B. Payment invoices must include the following information:(1) Invoice date;(2) Name of Contractor;(3) Pounds of waste collected;(4) Manifest numbers and date of shipment, including bill of lading number and weight ofshipment; and(5) Waste Profile Numbers as applicable.44. PAYMENTPayments shall be made by the Department on the basis of actual services completed according to the followingschedule:(A) The Department shall compensate the Contractor for its services at $2.07 per pound for the first 30,000pounds collected, but if more than 30,000 pounds of waste is collected then the rate shall be $1.42 perpound of waste collected. In additional to the rate per pound, an additional payment of $1,000 shall bepaid to the Contractor for each additional collection location,(B) The Contractor will receive fifty percent (50%) of the compensation to which it is entitled from theDepartment upon:1. Successful completion of the collection events and submission of required reports includingthe invoices, and2. Successful completion of the laboratory characterization of unknown waste and submission ofrequired reports.(C) An additional forty-five percent (45%) of the compensation which the Contractor is entitled will be paidas certificates of treatment or disposal are received. This payment will be made on a pro-rata basis. Forexample, if certificates are received covering 10% of the waste collected, 10% of the45% will be paid.(D) The final five percent (5%) shall be retained by the Department for payment until submission of a finalcontract report is approved and accepted by the Department and until final treatment/disposal of allwastes received during collection events, including the submission of “Certificates of Disposal”documenting the final treatment and/or disposal of the wastes.(E) Payments to Contractor shall fully compensate Contractor for all risk, loss, damages or expense ofwhatever nature and acceptance of payment shall constitute a waiver of all claims Contractor may have.This shall be the sole and complete compensation for services rendered by the Contractor.
