Tactics employed to accomplishthis include product exchanges, redistribution tablesand recycling centers.Programs to find a user for collectedpesticides must be well-planned and orchestrated,with good advertising, strong local leadership andon-site logistics management. Regulatory andliability issues may pose barriers to exchangeprograms when pesticides are transferred from oneowner to another. For example, many agriculturalproducts are restricted use products, which can onlybe distributed to applicators certified to use them.This means that before such products can beexchanged, someone has to check credentials at thecollection event. As a result, it may benecessary to have recipients sign waivers or lettersof understanding.Despite these considerations, Kansas,Kentucky, Nevada, Pennsylvania, Utah, Vermont,and Wisconsin allow exchange, generally on alimited basis. Texas has an exchange program forhousehold hazardous waste collections and triedhaving a “swap shop” for pesticides in sealed,unopened containers that were neither banned norrestricted. Ohio has donated useable products.Illinois attempted a swap program in 1994, butdiscontinued it because the Department of Agriculturefound that contacting the appropriate people tofacilitate the exchange was very time-consuming. Inaddition, Illinois determined there was considerableuncertainty about the quality of the products andconcluded that most products were in need ofdisposal. It is possible that other programs alsoState and local governments typically hirehazardous waste management companies to handlethe pesticides in Clean Sweep programs. In nearlyall programs, the contractor provides all materialsand services for collection, including manifesting,packaging, transporting and disposing of thecollected material. In many cases, the contractorwill collect pesticides at end-user locations ifcontainers are sufficiently deteriorated to maketransportation dangerous. The contractor mayassume all responsibility as the generator of thewaste and may hold the state harmless from anyclaims.Contracts include insurance such asworker’s compensation, general liability, andpollution liability. Contractors maintain a health andsafety program and are responsible for obtaining alllicenses, permits, manifests and other documentsnecessary for compliance with federal, state andlocal regulations, including those established by theOccupational Safety and Health Administration andDepartment of Transportation and EPA’s requirementsunder the Resource Conservation andRecoveryAct, Comprehensive EnvironmentalResponse Compensation and Liability Act (commonlycalled Superfund), and Superfund AmendmentsReauthorization Act. Site set-up andrestoration at single day events are the contractor’sresponsibility. In states that conduct on-sitecollections at participants’ sites, the contractor mayalso commit to stabilizing and cleaning up contaminatedsoil around deteriorated containers.
