Exceptions to this requirement may be approved by Council provided thedeveloper can demonstrate that:• The land can be developed and used for recreational purposes at least 80%of the time;• Recreational use of the land will not adversely affect the land’s values or itsassets;• Recreational use of the land will not create a safety risk to users.Cash contributions for public open space may be taken by Council for anysubdivision where land contributions are not required, and where there will bean increase in use of existing public open space as a result of the subdivision.Council will consider taking a cash contribution for public open space whenthe needs of the community and the conservation requirements can beadequately serviced by existing open space.Cash contributions will be used for:• Improvement or expansion of existing open space (consistent with theprecinct recommendations) and, or• Strategic land purchase to facilitate long term goals.In commercial areas, a cash-in-lieu public open space contribution may berequired to provide improvements to civic space, such as creation of meetingplaces, activity nodes, path networks and facilities.Additional open space may be obtained under agreements made under theLand Use Planning and Approvals Act 1993 - Part 5.
