5. Construction & Maintenance Periods.5.1 Pre-construction and construction.Prior to any construction or works taking place on any public open spaceareas, the developer must have a <strong>Council</strong> approved and endorsedLandscape Plan and Works Specification (Figure 3). Land set aside for publicopen space must be protected from disturbance during initial subdivisiondevelopment, such as road construction and the provision of infrastructure.<strong>Council</strong> must be notified in writing 2 weeks before public open spaceconstruction is planned to commence to arrange a pre-construction sitemeeting and/ or inspection. This is to ensure the areas set aside for publicopen space are consistent with those on approved plans, that the site isadequately prepared to protect significant features, and to establish aschedule of inspections during the development phase.<strong>Council</strong> will monitor landscape construction processes through a plannedand negotiated inspection routine including key witness and/or hold points.An additional site inspection will occur when construction is completed, toestablish Practical Completion of the works and mark the commencement ofthe 1 year maintenance period. This inspection will ensure that the site wasdeveloped according to the approved plan.<strong>Council</strong> must be notified of, and approve any changes to the approvedworks which are identified as necessary during the construction period.As-constructed drawings will be required if any changes are made to theapproved works.5.2 Statement of Compliance as it relates to open space provision.A Statement of Compliance is a written confirmation from <strong>Council</strong> that allworks and other requirements relating to a particular subdivision ordevelopment proposal have been completed satisfactorily and is requiredprior to the release of lots by the Titles Office.A Statement of Compliance is only issued when a developer has met allrequirements placed on a subdivision or development (usually in the form ofconditions on a Planning Permit), or an agreement entered into regardingtheir completion. The provision of <strong>Open</strong> <strong>Space</strong> is often one of a number ofdifferent actions that must be completed by a developer prior to the issuingof a Statement of Compliance. Other actions include the provision ofinfrastructure such as roads, electricity, water and sewerage mains.To meet the open space requirements for the issue of a Statement ofCompliance the developer must demonstrate that all permit conditions inrelation to <strong>Public</strong> <strong>Open</strong> <strong>Space</strong> and Streetscape Development provision havebeen completed to <strong>Council</strong>'s satisfaction.PART A: GUIDELINES FOR THE PLANNING & PROVISION OF PUBLIC OPEN SPACE PAGE 13
