clients who would not continue their policy subscriptions, the brokerages haveto repay these immediate and relatively large commissions to the insurancefirms. These criminal and syndicated brokerages exploited this system bydelaying repayments, only to eventually evade all liability by declaringthemselves bankrupt between June and September 2004. The insurancecompanies suffered a loss of HK$48 million.4.22 The incentives offered by the brokerages to prospective clientswere indicative of the nature of the scam, as many policies were offered free ofcharge, employment perks or as part of a lucky-draw prize. The Office of theCommissioner of Insurance has since tightened up measures to prevent similaroccurrences.Internet Banking Theft4.23 In 2004, 19 reports relating to Internet Banking were received.The total reported losses amounted to HK$2 million. These cases includedunauthorised online credit card transactions, the setting up of fraudulentaccounts as well as the unauthorised increase of credit card limits for cashwithdrawal and purchases.4.24 “Phishing” emails and bogus banking websites were also used todeceive victims of their personal details and passwords. Culprits succeeded instealing funds from the victims’ accounts and moved the stolen funds out ofHong Kong through remittance agencies. 29 persons were arrested in thisinternational scam. Nevertheless, none of the incidents involved a bank’scomputer system being compromised.Child Pornography4.25. With the enactment of the Prevention of Child PornographyOrdinance on 19 December 2003, the Hong Kong Police have endeavoured tocombat this disturbing crime. An intelligence-led operation codenamed“Storm-rider” was undertaken by CCB in March 2004. This operation resultedin the arrest of a total of 24 males with a seizure of abundant child pornographicmaterials in digital format. After seeking legal advice, 16 males were chargedwith the offence of “Possession of Child Pornography” and appeared in variousMagistracies. 13 out of 16 males have so far been convicted, and sentencesincluded several months of imprisonment for these ground-breakingprosecutions.113
