To help womensecure better marital conditions and divorce terms, the prenuptial “conditions”envisioned under Article 1119 of the civil code have been added tothe printed standard marriage contract. This reflects the Islamic traditionthat allows a woman to request certain conditions, such as the right todivorce and the right to a residence separate from her husband’s relatives.Although the validity of these stipulations is conditional upon theapproval of the prospective husband, they nonetheless provide an importantpotential protection. A prospective bride and her family may feelawkward requesting them during marriage negotiations, and men maysimply refuse to accept them. Furthermore, many women are unaware oftheir legal rights in this area. These factors weaken the potential protectionoffered by the practice, and unless such conditions become fully integratedinto the marriage law, many men will consider them to be “extra rights” or“privileges” to which they may refuse to submit.Many of the improvements made to women’s marital rights center onfinancial support offered to women during marriage and upon divorce.A woman is entitled to mehriyeh, a sum of money or object of monetaryvalue specified in the marriage contract that a husband is obligated to payto his wife. Generally, the dowry is paid upon divorce and is intended todeter men from initiating divorce or, failing that, to provide financial supportto divorced women. Article 336 of civil code was amended in 2006to allow a wife to demand monetary compensation from her husband fordomestic labor she performed during their marriage, particularly when theman initiates the divorce without a reasonable excuse. 37 Finally, a divorcedwoman is entitled to her jahiziyeh, the items she brought into the homeupon marriage.Although these provisions potentially protect the financial security ofwomen, in practice it is difficult to secure the mehriyeh or compensationfor domestic labor.
