While men areautomatically granted the “male” objects, in practice judges may arbitrarilyrequire women to prove that they bought the “female” items over whichthey claim ownership.Article 72 of the family code guarantees that, upon divorce, womenwho retain primary custody over their children will receive proper housing.This is a major improvement from the 1984 code, under which men keptthe marital home upon divorce, often forcing divorced women and theirchildren onto the streets. However, because of the current housing crisis,many judges allow divorced men to keep the house if they offer equivalentfunding to their ex-wives and children. Consequently, unemployedmen or those with low incomes provide too little money to allow their exwivesand children to find decent housing. Some argue that this new ruleencourages divorced men to more vehemently invoke their custody rights,because divorced women who do not retain custody of their children (andthose without children) are not entitled to alimony or housing. Womenwho remarry after divorce lose custody of their existing children.Women’s rights groups have indicated that the 2005 amendments tothe family code have not been properly implemented.
