Role of uni<strong>on</strong>s<br />
In both countries, uni<strong>on</strong>s have been weakening<br />
for a number of years. In El Salvador, for example,<br />
uni<strong>on</strong>s have a weak presence after decades of being<br />
repressed and <strong>the</strong>n being systematically disbanded.<br />
In Zambia, uni<strong>on</strong>s are historically associated with<br />
improving workplace c<strong>on</strong>diti<strong>on</strong>s, wages and benefits.<br />
However, labor uni<strong>on</strong>s have weakened since <strong>the</strong><br />
pinnacle of <strong>the</strong>ir political strength in <strong>the</strong> 1990s, with<br />
<strong>the</strong> adopti<strong>on</strong> of structural adjustment policies playing<br />
a major role in <strong>the</strong>ir demise. The ILO Freedom of<br />
Associati<strong>on</strong> and Protecti<strong>on</strong> of <strong>the</strong> Right to Organise<br />
C<strong>on</strong>venti<strong>on</strong> (1948) provides workers with <strong>the</strong> legal<br />
right to join and operate workers’ organizati<strong>on</strong>s<br />
without government or employer interference. The<br />
researchers found no evidence that <strong>the</strong> companies<br />
were preventing such organizati<strong>on</strong>.<br />
There are mixed levels of uni<strong>on</strong>izati<strong>on</strong> in <strong>the</strong> formal<br />
sector workplaces across <strong>the</strong> value chain in both<br />
countries. At <strong>the</strong> El Angel mill, <strong>the</strong>re is a good<br />
track record of dialogue and cooperati<strong>on</strong> between<br />
<strong>the</strong> uni<strong>on</strong> and <strong>the</strong> mill management owners. Mill<br />
employees report that uni<strong>on</strong>izati<strong>on</strong> has led to notable<br />
improvements in <strong>the</strong>ir working c<strong>on</strong>diti<strong>on</strong>s through<br />
collective c<strong>on</strong>tract negotiati<strong>on</strong>s.<br />
The employees at <strong>the</strong> Central Izalco Mill are not<br />
uni<strong>on</strong>ized and reported that workplace c<strong>on</strong>diti<strong>on</strong>s are<br />
generally satisfactory and that <strong>the</strong>y do not require a<br />
uni<strong>on</strong> to maintain c<strong>on</strong>diti<strong>on</strong>s.<br />
At SABMiller’s bottling plant in El Salvador,<br />
employees are not uni<strong>on</strong>ized, and <strong>the</strong>y report<br />
mixed views <strong>on</strong> <strong>how</strong> necessary it is to have a uni<strong>on</strong>.<br />
Some employees reported a c<strong>on</strong>cern that even if<br />
a uni<strong>on</strong> existed, <strong>the</strong>re may be lack of engagement<br />
by management. Despite some reports that<br />

uni<strong>on</strong> members might face discriminati<strong>on</strong> from<br />
management, this view is not widely held, and<br />
appears to stem from an incident in <strong>the</strong> late 1970s<br />
when <strong>the</strong> plant was under different ownership in<br />
which uni<strong>on</strong> members undertaking direct acti<strong>on</strong><br />
lost <strong>the</strong>ir jobs. Some employees advocated for a<br />
more effective forum to engage with <strong>on</strong>e stating<br />
that <strong>the</strong> current an<strong>on</strong>ymous employee engagement<br />
mechanism does not work and that moti<strong>on</strong>s<br />
presented in writing are not resolved.<br />
In Zambia, <strong>the</strong> uni<strong>on</strong> present at Zambian Breweries<br />
holds m<strong>on</strong>thly meetings between uni<strong>on</strong> members and<br />
management and overall appears to enjoy positive<br />
relati<strong>on</strong>s. However, some employees interviewed<br />
complained that <strong>the</strong> uni<strong>on</strong> was not particularly active.<br />
One employee blamed management for <strong>the</strong> uni<strong>on</strong>’s<br />
lack of effectiveness, claiming that “Management<br />
perceives <strong>the</strong> uni<strong>on</strong> as a nuisance... <strong>the</strong> uni<strong>on</strong> is left<br />
with just junior workers who cannot argue out issues<br />
very well. The uni<strong>on</strong> is struggling to survive.” 57 This<br />
is c<strong>on</strong>sistent with a nati<strong>on</strong>al trend of reduced trade<br />
uni<strong>on</strong> activity and influence. Ano<strong>the</strong>r employee felt<br />
that management unfairly restricted employees’<br />
ability to pursue o<strong>the</strong>r sources of income, given <strong>the</strong><br />
company’s restricti<strong>on</strong>s <strong>on</strong> employees selling<br />
<strong>Coca</strong>-<strong>Cola</strong> products through independent businesses.<br />
The complaint about this restricti<strong>on</strong>, driven by <strong>the</strong><br />
desire to avoid c<strong>on</strong>flict of interest, may imply <strong>the</strong>re<br />
is opportunity to streng<strong>the</strong>n dialogue between<br />
employees and management.<br />
While some grievance mechanisms are in place,<br />
<strong>the</strong>re is scope for <strong>the</strong>se to be improved in order to<br />
facilitate better communicati<strong>on</strong>. The establishment<br />
of well-defined, transparent processes for workers to<br />
share <strong>the</strong>ir views with management would streng<strong>the</strong>n<br />
relati<strong>on</strong>s and help ensure that labor standards are<br />
properly enforced, and some recommendati<strong>on</strong>s to<br />
this end are detailed below.<br />
<strong>Oxfam</strong> believes that where <strong>the</strong>re is a lack of<br />
robust industrial relati<strong>on</strong>s between workers<br />
and management, <strong>the</strong>re is limited scope for<br />
dialogue or collective acti<strong>on</strong> to alter policies<br />
and practices and to help ensure that labor<br />
standards are properly enforced.
