PERMIT APPROVALS.Act 68, SLH 20<strong>05</strong>, amends Section 91-13.5, HRS, by exempting proceedings of the<strong>Commission</strong> from the automatic permit approval provisions. Under Section 91-13.5, HRS,agencies must take action to grant or deny any application for business or development-relatedpermits, licenses, and approvals within a maximum time period as adopted in the agency’s rules.If no decision is reached within that time period, the application is automatically approved.3. STANDARDS FOR NET METERED RENEWABLE ENERGYSYSTEMS.Act 69, SLH 20<strong>05</strong>, requires the <strong>Commission</strong> to adopt interconnection standards andregulations removing impediments to the installation of eligible customer-generator systems witha capacity greater than ten (10) kilowatts. Specifically, the <strong>Commission</strong> is required to: (1) setforth safety, performance, and reliability standards and requirements and (2) establish thequalifications for exemption from a requirement to install additional controls, perform or pay foradditional tests, or purchase additional liability insurance.4. NET ENERGY METERING.Act 104, SLH 20<strong>05</strong>, establishes provisions relating to maximum capacity of eligiblecustomer generator. The eligible customer-generator shall have a capacity of not more thanfifty (50) kilowatts. The <strong>Commission</strong> is allowed to increase the maximum allowable capacity. The<strong>Commission</strong> is allowed to increase the total rated generating capacity produced by eligiblecustomer-generators to an amount above .5 per cent of the electric utility’s system peak demand.The <strong>Commission</strong> is authorized to amend the rate structure or standard contract or tariff. Excesselectricity generated by the customer-generator in each monthly billing period is required to becarried over to the next month as a monetary value to the credit of the eligiblecustomer-generator. The electric utility is required to reconcile the eligible customer-generator’selectricity production and consumption of energy for each twelve (12)-month period.5. REGULATION OF SEAWATER AIR CONDITIONING.Act 164, SLH 20<strong>05</strong>, exempts persons who own, control, operate, or manage seawater airconditioning district cooling projects from regulation by the <strong>Commission</strong>. The exemption applieswhen at least fifty (50) per cent of the energy required for the seawater air conditioning districtcooling system is provided by a renewable energy resource, such as cold, deep seawater.6. COMMISSION SALARIES.Act 226, SLH 20<strong>05</strong>, adjusts the salary of the chairperson of the <strong>Commission</strong> by setting itat eighty-seven (87) per cent of the director of the Department of Human ResourcesDevelopment.B. THE 20<strong>05</strong> LEGISLATURE ENACTED OTHER UTILITY-RELATEDMEASURES RELATING TO:1. APPROPRIATION FOR WIRELESS ENHANCED 911 FUND.Act 42, SLH 20<strong>05</strong>, makes an emergency appropriation of $3,<strong>05</strong>0,000 for the WirelessEnhanced 911 Fund (“Fund”), which is administered by the State Department of Accounting andGeneral Services, to reimburse public safety answering points and wireless providers fortechnical improvements and for the operating costs of the Fund. Act 159, SLH <strong>2004</strong>, whichestablished the Fund, did not provide an appropriation from the Fund.
