HynixSemiconductor Inc. and HynixSemiconductor America Inc.subsequently instituted an action at theCIT challenging the Commission’sdetermination.The CIT issued an opinion in thematter on April 13, 2006. HynixSemiconductor Inc. v. United States, Ct.No. 03–00652, Slip Op. 06–52 (Ct. Int’lTrade Apr. 13, 2006). In its opinion, theCIT remanded the matter to theCommission for further consideration ofthe causal nexus between the subjectimports and material injury to thedomestic DRAMs industry in light ofchanges in the rate of growth ofdemand. In all other respects the CITaffirmed the Commission’s opinion.Participation in the ProceedingOnly those persons who wereinterested parties to the originalinvestigation (i.e., persons listed on theCommission Secretary’s service list)may participate in the remandproceedings. Such persons need notmake any additional filings with theCommission to participate in theremand proceedings. Businessproprietary information (‘‘BPI’’) referredto during the remand proceeding will begoverned, as appropriate, by theadministrative protective order issuedin the original investigation.Written SubmissionsThe Commission is not reopening therecord in this proceeding for submissionof new factual information. TheCommission will, however, permit theparties to file comments pertaining tothe issue on which the CIT hasremanded this matter. The deadline forfiling comments is May 25, 2006.Comments shall be limited to no morethan twenty (20) double-spaced andsingle-sided pages of textual material.The parties may not submit any newfactual information and may not addressany issue other than the impact on thedomestic industry of changes in the rateof growth of DRAM demand. Commentsfiled in the Commission section 129consistency proceeding concerningDRAMs and DRAM Modules from Koreaare not part of the record of theseremand proceedings. Accordingly, thecomments submitted in this remandproceeding may not cite or incorporateby reference comments submitted in thesection 129 consistency proceeding.Any material from the comments in thesection 129 proceeding that isreproduced and appended to orincorporated within the comments filedin these remand proceedings will becounted against the 20-page limit forcomments.All written submissions must conformwith the provisions of § 201.8 of theCommission’s rules; any submissionsthat contain BPI must also conform withthe requirements of §§ 201.6, 207.3, and207.7 of the Commission’s rules.
