ARTICLE 11GRIEVANCE PROCEDURESection 1. This negotiated grievance procedure shall apply to matters of concern ordissatisfaction regarding the interpretation, application, or violations of law, regulations, or thisagreement; conditions of employment, including prohibited personnel practice charges; <strong>and</strong>disciplinary <strong>and</strong> adverse actions. It shall apply to all matters indicated above, whether or not setforth in this agreement.Section 2. The Union <strong>and</strong> the Employer recognize the importance of settling disagreements <strong>and</strong>disputes in a prompt, fair, <strong>and</strong> orderly manner which will maintain the self-respect of the partiesinvolved <strong>and</strong> be consistent with the principles of good management. To accomplish this, everyeffort will be made to settle grievances expeditiously <strong>and</strong> at the lowest possible level ofsupervision.Section 3. Excluded from coverage of this procedure are all issues which involve:a. Prohibited political activities.b. Retirement, life insurance, or health insurance.c. A suspension or removal under Section 7532 of Title 5, United States Code (NationalSecurity).d. Any examination, certification, or appointment.e. The classification of any position which does not result in the reduction in grade or pay ofan employee.f. The non-adoption of a suggestion or disapproval of a performance award, or other kind ofhonorary or discretionary award, except where this is alleged to be based on reprisal.g. Termination of a temporary promotion <strong>and</strong> return of the employee who was temporarilypromoted to the position from which temporarily promoted.h. Non-selection for promotion from a group of properly ranked <strong>and</strong> certified c<strong>and</strong>idates,except where personnel practices prohibited by law are alleged.i. A preliminary warning or notice of an action which, if effected, would then be eligible forconsideration as a grievance.j. Separation of employees during probationary or trial periods.18
