ARTICLE 6MANAGEMENT RIGHTSSection 1. Rights Retained. The Employer retains the right to determine the mission, budget,organization, number of employees, <strong>and</strong> internal security practices of the agency; <strong>and</strong> inaccordance with applicable lawsa. To hire, assign, direct, lay off, <strong>and</strong> retain employees, or to suspend, remove, reduce ingrade or pay, or take other disciplinary action against employees;b. To assign work, to make determinations with respect to contracting out, <strong>and</strong> to determinethe personnel by which the Employer's operations shall be conducted;c. With respect to filling positions, to make selections for appointments from among properlyranked <strong>and</strong> certified c<strong>and</strong>idates for promotion or from any other appropriate source; <strong>and</strong>d. To take whatever actions may be necessary to carry out the Agency mission in situations ofemergency.Section 2. Future Agreements. The requirements of this <strong>Article</strong> shall apply to all supplemental,implementing, subsidiary, or informal agreements between the Employer <strong>and</strong> the Union.Section 3. The right to bargain over the impact of any decision involving a retained right, <strong>and</strong> theright to negotiate procedures implementing such decisions, shall not be abridged by anything inthis <strong>Article</strong>.Section 4. Nothing in this section shall preclude the Employer <strong>and</strong> the Union from negotiatinga. Procedures which management officials of the agency will observe in exercising anyauthority under this section; orb. Appropriate arrangements for employees adversely affected by the exercise of anyauthority under this section by such management officials.Section 5. Wherever language in the agreement refers to specific duties or responsibilities ofspecific employees or management officials, it is intended only to provide a guide as to how asituation may be h<strong>and</strong>led. It is agreed that the Employer retains the sole discretion to assign work<strong>and</strong> to determine who will perform the function discussed.8
