The <strong>College</strong> may refer for prosecution all violations of theStandards of Conduct which are similar in nature to criminal conduct consistent with local, state and federal law.Description of the Applicable Legal Sanctions under Local, State or Federal Law for the Unlawful Possession orDistribution of Illicit Drugs and AlcoholVarious legal penalties including the imposition of fines and/or incarceration exist for individuals who commitcriminal violations of local, state, and federal laws governing controlled substances and alcoholic beverages.<strong>Student</strong>s are further reminded that North Carolina state law stipulates that any individual under the age of 21 yearswho purchases, consumes, possesses or transports alcoholic beverages is in violation of the law. Also as of October1, 1993, the legal level of intoxication while driving a vehicle is 0.08.<strong>Mount</strong> <strong>Olive</strong> <strong>College</strong> will cooperate with law enforcement in performance of its duties. The <strong>College</strong> will not askfor, encourage, or expect any special treatment for any student accused and/or convicted of violating local, state orfederal laws. Any <strong>College</strong> judicial action taken will be separate from any criminal or civil action, even if resultingfrom the same incident or circumstances.The <strong>Student</strong> Development Office should be contacted for assistance in locating copies of any applicable local, stateor federal laws.Biennial ReviewIn accordance with the Act, <strong>Mount</strong> <strong>Olive</strong> <strong>College</strong> will review on a biennial basis the aforementioned program todetermine its effectiveness and implement changes if needed and to insure that the sanctions developed areconsistently enforced. <strong>Mount</strong> <strong>Olive</strong> <strong>College</strong> encourages and welcomes suggestions from students.Policy Statements Regarding Sexual Assault & Sex Offenses7.3In accordance with the revised requirements of the <strong>Student</strong> Right-to-Know and Campus Security Act, <strong>Mount</strong> <strong>Olive</strong><strong>College</strong> puts forth the following policy information to all students and employees.Educational ProgramsThroughout the year students are afforded the opportunity to raise awareness about prevention of rape, acquaintancerape, and other forcible and nonforcible sex offenses. These educational efforts are offered through seminars,workshops, and printed materials. Additional information is available upon request to the <strong>Student</strong> DevelopmentOffice, the Residence Life staff, and Health Services.Procedures to Follow in the Event of a Sex OffenseIn the event of a sex offense or sexual assault, the student should immediately contact the appropriate <strong>College</strong>official (in <strong>Mount</strong> <strong>Olive</strong> – the Residence Life Coordinator or Campus Safety Officer on duty; in Goldsboro,Jacksonville, New Bern, Research Triangle Park, Washington or Wilmington – the director of that location) forassistance and to report the incident. That official will then contact the Vice President for <strong>Student</strong> Development. Itis very important that any evidence be preserved as evidence of a criminal offense. For this reason, the student iscautioned not to bathe or shower, not to clean the room or area, and not to throw anything away until he/she hasreported the incident and allowed the <strong>College</strong> officials or law enforcement officers to take control of the scene.Notification to Local Law EnforcementIn accordance with the law, <strong>Mount</strong> <strong>Olive</strong> <strong>College</strong> will notify local law enforcement in the event a sexual assault isreported to a <strong>College</strong> official. It is always the right of the student to notify law enforcement authorities directly or tochoose not to speak with the authorities. The <strong>College</strong> will assist the student in contacting local law enforcementupon request.Counseling Services for Victims of Sex Offenses55
