This includesthose members of the <strong>College</strong> Community who are involved in off-campus programs such as internships andcooperative programs. This policy applies to the workplace, recruitment, appointment, and advancement ofemployees. It also applies to student contact in and out of the classroom and the evaluation of students’ academicperformance.Family Rights and Privacy Act (Buckley Amendment)7.5<strong>Student</strong> Right to Privacy: Family Educational Rights and Privacy Act of 1974Policies and Procedures at <strong>Mount</strong> <strong>Olive</strong> <strong>College</strong>In accordance with the Family Educational Rights and Privacy Act, <strong>Mount</strong> <strong>Olive</strong> <strong>College</strong> has adopted the followingpolicies and procedures. It is the objective of the <strong>College</strong> to insure that legal rights of students, established under theFamily Educational Rights and Privacy Act of 1974, be clearly understood and protected by all those affected.1. All individuals who are attending or have attended <strong>Mount</strong> <strong>Olive</strong> <strong>College</strong> have a right to review and inspecttheir educational records.2. Requests by students for access to or copies of their educational records must be completed within areasonable period of time, not to exceed 45 days from the date of request. (Normally, records are outwithin a week)3. An educational record is defined as data, in any form, about a student of the <strong>College</strong> or a <strong>College</strong> officialexcept:a. Records solely in the possession of the maker and not revealed in any form to third party.b. Records related to employment.c. Records of physicians, psychiatrists, etc., that are maintained in the course of treating a studentand used only for that purpose. <strong>Student</strong>s do not have a right of access to those records, but theywill be released to a physician or psychiatrist of a student’s choice.4. Requests by students for access to or copies of their educational records must be made to the institutionalofficial responsible for maintaining those records.5. All requests by students for access to their educational records may be made orally to the <strong>College</strong> officialresponsible for the record, unless said official asks that the request be in writing.a. Access to educational records will not be permitted to third parties unless: The student has givenwritten consent to release the record; orb. The individual or agency requesting information is included under Section 99.31 of the FederalRegulations, which permits release of an educational record, without the student’s consent, to thefollowing organizations or individuals:• To <strong>Mount</strong> <strong>Olive</strong> <strong>College</strong> school officials who have a legitimate educational interest(See paragraph 7)• To officials of other school systems in which the student seeks or intends to enroll• To certain Federal and State officials for auditing purposes• To persons or organizations involved in financial aid matters related to the student• To organizations conducting studies for the <strong>College</strong>• To accrediting organizations• To parents of a dependent student (See paragraph 8)• To comply with a judicial order or subpoena, provided that a reasonable effort to notifythe student is made in advance.• To appropriate parties in a health or safety emergencyNOTE: Parents of students under 21 years of age may be notified58
