SCOPE OF RULES - ONE FORM OF ACTION.LCvR1.1 Purpose and Scope of Rules.These local civil rules are promulgated to supplement the Federal Rules of CivilProcedure with local court procedure. Appendix I contains a listing of General Orders whichare available from the Court Clerk or on the Court’s website, www.okwd.uscourts.gov.LCvR1.2(a)Rules of Procedure.The rules of procedure in any proceeding in this Court shall be as prescribedby the laws of the United States, the rules of the Supreme Court of the United States, theFederal Rules of Civil Procedure, the Federal Rules of Criminal Procedure, any applicablerules of the United States Court of Appeals for the Tenth Circuit, and these local rules.(b)Where in any proceeding or in any instance there is no applicable rule ofprocedure, a judge may prescribe the same.(c)The trial judge has discretion in any civil or criminal case to waive anyrequirement of these local rules when the administration of justice requires.(d)These local rules shall be known as the Local Civil Rules of the United StatesDistrict Court for the Western District of Oklahoma. They may be cited as “LCvR .”II.COMMENCEMENT OF ACTION AND SERVICE OF PROCESS.LCvR3.1 Civil Cover Sheet and Format of Initiating Document.Every document initiating a civil action in this Court (e.g., complaint, petition, ornotice of removal) shall be accompanied by a completed civil cover sheet, Form JS-44, which
is available from the Court Clerk’s office or on the Court’s website. Counsel and pro selitigants are required to number each party separately in the caption of the initiatingdocument, plaintiffs consecutively and defendants consecutively. Pro se litigants are alsorequired to complete the form furnished by the Court for issuance of summons.LCvR3.2Advance Payment of Filing Fees.Except as provided in LCvR3.3 or by order of the Court in a specific case, the Clerkof this Court shall require payment of the filing fees before any civil action, suit, orproceeding is filed.LCvR3.3(a)In Forma Pauperis Applications.An applicant who seeks leave to proceed without prepayment of the filing feesmust, at the time of initiating the civil action, suit, or proceeding, submit an application toproceed in forma pauperis on forms approved by this Court and supplied by the Clerk uponrequest. Failure to use such form or to furnish the Court with the equivalent informationrequired by the form will result in the application being stricken.(b)In the case of a prisoner, such application must also include a certificateexecuted by an authorized officer of the appropriate penal institution stating: (1) the amountof money or securities currently on deposit to the prisoner’s credit in any institutionalaccount; (2) the average monthly deposits to the prisoner’s account for the 6-month periodimmediately preceding the filing of the action; and (3) the average monthly balance in theprisoner’s account for the 6-month period immediately preceding the filing of the action.(c)In the event the prisoner has been in more than one penal institution during the6-month period immediately preceding the filing of the action, the prisoner must obtain therequired certificate from the appropriate official at each institution.(d)Pending the Court’s ruling on the application, the civil action, suit, orproceeding will be deemed conditionally filed.-2-
