LCvR39.3(a)Use <strong>of</strong> Electronic Devices, Photographs, or Tape Recorders at Trial.The taking <strong>of</strong> photographs and operation <strong>of</strong> tape recorders and radio ortelevision broadcasting in the courthouse during the progress <strong>of</strong> or in connection with judicialproceedings, including proceedings before a United States Magistrate Judge, whether or notCourt is actually in session, is prohibited.(b)A judge may, however, permit the use <strong>of</strong> electronic or photographic means forthe presentation <strong>of</strong> evidence or the perpetuation <strong>of</strong> a record, and the broadcasting, televising,recording, or photographing <strong>of</strong> investitive, ceremonial, or naturalization proceedings.(c)The Court prohibits the use <strong>of</strong> cellular telephones, pagers, or other electroniccommunication devices in the courtroom. Such devices may be carried on the person withina courtroom only if the device is turned <strong>of</strong>f or non-auditory.LCvR39.4(a)Use <strong>of</strong> Exhibits at Trial.Marking and Disclosure. Unless otherwise ordered, all exhibits anddocuments which are to be introduced in evidence are to be marked for identification, whichshall include the case number, and physically exchanged or exhibited to opposing counselat least 3 business days before submission <strong>of</strong> the pretrial report.(b)Withdrawal. Unless otherwise ordered by the Court, all exhibits introducedin evidence in the trial <strong>of</strong> the case shall be withdrawn at the close <strong>of</strong> trial and remain in thecustody <strong>of</strong> the party introducing the evidence. The Court may order the party introducingexhibits which are bulky, heavy, firearms, or controlled substances to retain custody <strong>of</strong> suchexhibits during the trial. Any such order shall provide for preservation <strong>of</strong> the exhibit asjustice may require.(c)Photographs for Appeal. Exhibits, diagrams, charts, and drawings on ablackboard may, under the supervision <strong>of</strong> the Court, be photographed for use on appeal orotherwise.-20-
